CASE FOR COMPENSATION

1. I, Cdr Deepak Verma had purchased LG computer on 10 Jan 09. The product carried a warranty of 3 years. CPU Sl no is 811NLTR000633 and Model Number is L7047B4383. The relevant bills are forwarded herewith as enclosure to this letter.
2. The CPU has started misbehaving since May this year. The computer automatically shuts down and again starts rebooting again. Sometimes it just does not restart after shutting down automatically. Several complaints were registered for getting this computer rectified. The details of the complaint are as follows:-
- RNA 110514007491 dated 14 May 11.
- RNA 110715032452 dated 15 Jul 11.
- RNA 110227086434 dated 22 Jul 11.
- RNA 110728040463 dated 28 Jul 11.
- RNA 110806076123 dated 06 Aug 11.
- RNA 110918031419 dated 18 Sep 11.
3. The company has attempted several times to get this CPU on line. The Mother Board was also changed during the rectification but to no avail. Later, the defect was attributed to the software problem and was informed that the software problem is not covered under warranty. Therefore, I got the whole Operating System re- loaded by paying additional charges, but, the problem still existed. Thus, in order to rule out the software problem, the CPU was picked up by the LG company engineer and authentic software was reloaded with the top class antivirus system. Thus, it was ensured that the problem should not reoccur due to software problem. However, when the system was switched on, the same problem reoccurred. As the software along with antivirus was reloaded by the company itself, the problem could now be attributed to the hardware malfunction only. I was made to speak to Mr Anil, who is the country head for LGE service operations at Noida. He was very reluctant to accept that the problem in the computer could be because of Hardware and was insisting that the problem is because of software and that is not covered under warranty. Thereafter, I offered to pay for the purchase of new software for the computer. It was agreed by Mr Anil that the new software plus antivirus would be loaded under the supervision of the LG technicians and even then if the computer fails to come on line then full refund of the amount would be made to me. On this agreement, the computer was again picked up by the company in Oct 11. Later I got a call after two weeks that the Mother Board of the computer was unserviceable and that the same is not available in India. Company is trying to import from Korea. The computer duly repaired would be handed over to me by 10 Nov 11. Presently, the CPU is lying with the company with the same problem that existed in May 11. I have reminded the company of the promise made by Mr Anil and the suffering I am going through because of non availability of the computer, but still there is no response from the company.
4. I have two children studying in class 7th and 10th respectively. They are regularly tasked by the school to undertake studies or make projects for which the availability of Internet is must. Due to the recurrent problem of CPU, the studies of my children have been severely affected. They are unable to submit their assignments which involve computer work/ use of internet since May 11. As a result their performance in the class has been affected which would have a far reaching consequences especially for my daughter who is in 10th standard. I had been requesting for a service PC from the company but the same has been refused with the pretext that they don’t have one.
5. I have been actively involved in online trading and the same could not be followed due to non availability of the computer. Thus I have been made to lose lot of money over a period of last six months.
6. The stage has come that the company reps have stopped picking up my calls on their mobiles after noticing my number on their mobiles.
7. In view of the harassment suffered by me and my family, I would like to file a case for compensation of Rs 10 lakhs against M/s LG E Ltd Company.
