    Angry Problem with abn amro credit card

    Dear sir,

    my credit card no is 5415382314244500, issued around oct'05. Till today
    i have
    made no purchase by your credit card. But from jan'o6 onwards regularly
    i am
    being disturbed over phone by abn amro staff that i have purchased
    something worth rs.8047/-
    and i have to pay the bill but till date no statement came to me and
    the outstanding
    amount is rs. 11689/-.

    After repeated emails they sent me one statement where only the
    outstanding amount is written , no purchase particulars are not
    mentioned-which clears that it is a fake or framed bill.

    I am really surprised by seeing their attitude for charging me for a
    fake expense and
    moreover putting interest on it.

    Two years back (april'06)their kolkata branch official mr rakesh biswas
    rang me up and said that the
    rs.8047/- was mistakenly posted on my card and after interest
    calculation the amount
    became rs.11000/- odd.so he requested me to pay rs.100/- for closing of
    the account
    and settlement, i paid rs. 100/- on 24.04.06 by cash (receipt copy
    7039).but from 18.05.06
    onwards i am getting phone calls from your kolkata office for payment
    by mr sujit and
    mr rathi.

    Then i rang up mr biswas, he told me that they may not be knowing the
    real reason and my
    account has not been closed as head office has declined to do so, and
    he had again approached
    to his head office.

    Till today i am getting phone calls from their various branches from
    all over india and they are verbally abusing and threatening and
    abusing me for false outstanding payments and more over they pleaded me
    for paying rs. 6000/- odd to close the chapter.

    Last week also one person came to my house in my absence and called in
    my names and my family members didn't open the door as they know this
    matter very well.

    Now i do not want get phone calls from your end and requesting you to
    cancel my card as i don't
    want their service.

    Furthermore as i have not purchased anything by using their card, i am
    not going to pay them any
    thing.

    you have to file an FIR against this case only then the action will be taken as it is a fraud done by some farudster and bank will not take any action unless FIr is lodged

    Default Harrassed by Bank HDFC Collection Depatment

    PFA the details of the harrasement . Even after complaining there was no respnse from the bank and I am getting harrassement calls continuously .

    This is to bring to your notice that my family members along with me have been harrased by one of your bank employee Souvendu Bhowmik. For your reference the nos he called from are 22540465,22540467,22540468,22540469,22540466
    This is regarding behaviour of your collection people and their rude behaviour

    I have 2 HDFC bank Credit Cards ( 4346771007251292 ,5176358010515541 ). I hve been making regulatr payments , however for the last 8 months I have requested several times for a settlement for th ecards as I am going through a financial crisis.I hope that a person making regular paments for more than a yaer , I have already paid more than my credit limit without any benifit .
    This month when i recieved a call from the above mentioned agent I told him that I wanta settlement and would not be able to make the mimimum payment as everymonth I have been told to make the payment and settlement would be arranged for me , which never happened. So this person started talking rudely and said I have to make the payment and he will keep on disturbing me. I asked him not to call me , but he even started calling my home and abusing my family members .

    So I called up the helpdesk no at 44005391 and wanted to Speak to Ms Emon , she was not available and I spoke to Shilpi from her team , she told me that she would forward the request of settlement to chennai and I would not recieve calls from the person anymore . Next day I recieved a call from a lady who said she was the manager of the above mentioned agent and that there was no point escalating because it to come back to her .She even insisted me on paying the minimum amount and started blasting at me without understanding my problem.

    Afetr that yesterday the same person called me again , I told him that I have spoken to Ms Emon's team and she said that the case would be taken care of .Again today evening this person called me and told me that he found out that Ms Eman is not aware of anything and I would have to make the payment . So I told him do not disturb me as I was in the middle of something very important but he said he would disturb me . Then he satrted calling my home and started abusing my mother and suster in law and whatever possible language he could .

    Is this what the you call customer service? Your people does not know how to speak and they are not bothered if cistomers have spoken to to someone senior .This is what you teach your employees , how to behave with your customers ? Don t you have any kind of call monitoring system and Quality guidelines while speaking to the customers .How could your employes use abusive language with ladies and elderly persons ? This really calls for a step that customers should take against people harassing them

    Dear Manoj,

    I am still getting calls from the below mentioned collection agent . He called almost 100 times today. I then Called up Shilpi and informed her aout the same .THis person again called me and my home and spoke filthy words to my mother. He also informed me that by complaining , there would be no solution and that I have to make the payment else he would not stop calling . He kept on calling me and stated that I have chected banks money and that I have to payback . I again reminded him that the request for settlement for my card has been forwarded by Shilpi as she informed me , but this person said that I was lying about Shilpi and more unprofessional words. I think when your collection people are calling customers they are supposed to be professional but it seems that it is not with your bank . However I feel sorry that I have major accounts and other links with your bank which I would have to withdraw and also take this up with people who would be
    able to guide me . Because your employees don't even bother about complains , they are unprofessional and it seems there are no CODE OF CONDUCT maintained in your bank. This time this person started callin me from a different no so that his calls are not recored , or i think your bank does have the call recording system.

    Do i get any kind of response from any one from your bank regarding this issue ?

    It is very upsetting that your bank do not respond to important mails . Well I got harrased by your bank employee today over the phone as he called me up more tan 100 time and kept my phone busy from morning till 7 in the evening . He even abused my mother with filthy language .and still the bank is not responding . Are you trying the customers patience ? Well this is going to far and no one is responding to this as per the RBI regulation I am being verbally harrassed and being threatened . Your employee had the audacity of threating my mother saying that he his coming with police and would arrest my mother . This is really comtempt and I would go to the Court for Justice now .

    Thanks but no Thanks for nothing and let me also bring it to the notice odf the media cause people should be aware how HDFC bank customer are treated .

    Default HDFC credit card customer service

    Hi,

    I have HDFC value plus credit card no xxxx xxxx xxxx 3570.
    My due date is 23rd of the month so I always drop a local cheque either on 20th or 21st of month. This time I made it on 21st Nov 09. It seems there has been delay from the bank side to collect the cheque from the drop box & they received the cheque on 26th Nov 09. As a result, they have imposed a late payment & interest charges of 800 INR on me. Well I feel I made the payment in time then why shall I pay for the late payment. Also Customer care folks argued with me.

    Default Never applied for HSBC Credit Cards

    Dear Sir,

    I am Deepak Kumar Jain from Bangalore. Recently i have applied for House Loan In State Bank of Mysore. I got the reply from bank my loan is not approved due to DEFALUT in cibil report. Further to this case as follows.

    I approach CIBIL ( My Control No with CIBIL is 41 01 34 821 dtd 09-11-2009) to get the infromation about the WRITTEN OFF ( Rs 1,02,435 dtd 14-08-2003 and Rs 1,78,401 dtd 18-09-2001) money from the bank. After 12 reminder in 20 days i got the reply from CIBIL as followis

    01 Account No ( Card No ) 4476 9212 0516 1148 by HSBC Babk

    02. Account No ( Card No) 5548 3742 7989 2167 by HSBC Bank

    03. Account No ( Card No ) 4476 9299 9988 6705 by HSBC Bank

    04 Account No ( Card No ) 5548 3700 0976 1854 by HSBC Bank

    after getting the above information approach to HSBC Bank Basvangudi Branch and ask for the information they give us their E mail Id and told me to do the corrospondance through email.

    After doing the corrospondance with the HSBC bank they are asking for all type of information like PAN Cards Add Proof etc. My worry is that they may misuse the same to protect them. I am worrted with following concern.

    01. The above cards has been issed at Delhi Add. ( In my 38 Years of life i never stayed in Delhi as a resident.

    02. I never applied for Credit Cards in HSBC Bank.


    We need the solution for the above as my House constructiion is held up and incuring the heavy losses every day

    ORDER
    The complainant has prayed for the following directions to the opposite parties:-

    (i)To direct the opposite parties to comply with the deficiency in service and issue a settlement of all dues letter to the complainant,

    (ii) To direct the opposite parties to refund the entire amount taken from his saving bank account bearing No.00761000048331, with accrued interest,

    (iii) To hold the opposite parties deficient in their service and for using unfair trade practice direct the opposite parties to pay to the complainant in the form of damages an amount of Rs.2,00,000/- towards the mental trauma, physical strain and immense stress caused by the opposite parties,

    (iv) To pass any such order of relief that this Honorable Forum may seem fit to grant in the circumstances of the case,

    (v) To award costs of this dispute recoverable from the opposite parties.

    The case of the complainant is as under:-
    He is working for a private limited Company and residing at Bangalore. He availed credit card No. 4050 2820 0026 7851 from the opposite parties and the credit card was issued on his account No.00761000048331 with credit limit over lakh of rupees. He had been using the credit card for purchases and repaying the amount within the prescribed period till the year 2005. He had taken insurance policy and the premium in that regard was payable quarterly. He availed smart pay facility from the opposite party for payment of the insurance premium of Rs.2,500/- per quarter and he had 45 days time to make payment of the said amount to the opposite parties. The opposite parties were to make payment of Rs.2,500/- towards quarterly premium, but from the statement dated: 23.12.2005 he noticed that instead of Rs.2,500/- the opposite parties had paid Rs.5,033/- towards premium. Immediately he approached the opposite parties on various dates and informed that they had made payment of Rs.2,500/- in excess towards insurance premium and requested to sort out the issue.

    He made payment of Rs.3,013/- through cheque No.311895 being the remaining amount after deducting the additional amount paid by the opposite parties. He also requested the opposite parties to stop smart pay facility and as per the letter dated: 21.01.2006 the opposite party cancelled the said facility with effect from 18.11.2006. Since then he has been in constant touch with opposite parties seeking clarifications about the additional payment made from his account. But the opposite parties evaded the quires and have kept on charging interest and late fee on the said amount. Though he has paid the entire outstanding dues he was getting bills of payment of dues which were actually not due and payable by him. He addressed several e-mails to the opposite parties. After receiving the entire outstanding amounts the opposite parties never issued any letter of settlement. Since he was repeatedly calling and sending e-mails to the opposite parties one official called him over phone and requested to approach opposite party No.1 and to show the receipts regarding payments and to collect a settlement letter. When he approached opposite party No.1, he was made to wait for long hours and finally one of the customer care people informed that they would get back after they have the information, but so far no reply is given. The opposite parties had in fact freezed and were threatening to set-off the funds available in his SB account. The opposite parties issued letter dated: 04.11.2008 calling upon him to remit the alleged outstanding amount of Rs.21,866.77 paise within seven days failing which, the amount would be debited to his SB account as per the ‘cross default’ clause of the card member agreement.

    Thereupon he issued a legal notice dated: 12.11.2008 calling upon the opposite party not to forfeit the outstanding in the savings account. When he tried to contact the opposite parties in respect of the said letter one Gowda and another threatened him. Till date he has been receiving the letters, statements and SMS on his mobile stating that he has not paid the dues. He fails to understand that in spite of paying the entire amount his account shows an outstanding. The opposite parties have not only committed mistake in calculating the outstanding, but have forfeited the entire amount available in his savings account and have thus subjected him to lot of mental trauma and physical strain. Hence the complaint.

    2. In the version the contention of the opposite parties is as under:-

    Earlier the complainant had obtained a silver credit card with credit limit of Rs.65,000/- in the year 2005. Thereafter the credit card was upgraded to Visa- Platinum – Plus – Credit - Card with credit limit of Rs.1,55,000/- in the year 2007. The complainant had taken ‘Smart Pay Facility’ on the credit card to pay the insurance premium as and when demanded by the Insurance Company. Accordingly the amount was paid as per the demand made by the Insurance Company. They have no knowledge about the terms of the policy like the amount of premium and its period. They are only concerned with the payment of the respective demand made by the Insurance Company and they have promptly paid the amount towards premium.

    They have no knowledge that the complainant has to pay Rs.2,500/- towards quarterly premium. The complainant was required to implead the Insurance Company also as a party to the proceedings. As per the request of the complainant the Smart Pay Facility was cancelled with effect from 18.11.2006. From August-2008 the complainant is not making any payment though there is sufficient balance in his credit card account. As per the statement dated: 23.10.2008 the complainant is due Rs.21,866.77 paise and the complainant has not come forward to pay the said amount in spite of repeated request and reminders and has filed the present complaint without proper reasons. Since the complainant fails to make payment of the dues in spite of several requests and reminders they exercised right of “General Lien” on the amount available in the SB account of the complainant to an extent of Rs.18,140.43 paise with effect from 04.11.2008 and the same has been intimated to the complainant through notice dated: 04.11.2008 by which the complainant was called upon to pay Rs.21,866.77 paise. They have every right of exercising ‘General Lien’ as per the card member agreement.

    Therefore there is no illegality on the part of the opposite parties. The complainant is liable to pay the utilized amount by using the credit card. The complainant has not approached this Forum with clean hands and therefore not entitled to the relief prayed for.

    3. In support of the respective contentions, both the parties have filed affidavits, have produced documents and have filed written arguments.

    4. The points for consideration are:-
    (1) Whether the complainant has proved deficiency in service on the part of the opposite parties?

    (2) Whether the complainant entitled to the relief prayed for in the complaint?

    5. Our findings on the above points are in the Negative for the following:-
    REASONS
    POINT Nos. 1 & 2:-
    6. The complaint is filed on 18.12.2008 alleging that, as per the statement dated: 23.12.2005 the opposite party has paid Rs.2,500/- in excess towards the insurance premium under the Smart Pay Facility. If the complainant noticed excess payment made by the opposite party towards the insurance premium in the monthly statement dated: 23.12.2005, the cause of action to claim refund of the excess payment made accrued to the complainant on 23.12.2005. As such, the complainant was required to file the complaint seeking relief in respect of the excess payment within two years from 23.12.2005 as provided in Section 24 of the Consumer Protection Act. The complaint filed on 18.12.2008 is beyond the period of two years and as such, the claim of the complainant in respect of excess payment of Rs.2,500/- towards insurance premium is barred by limitation. The complainant has not even filed application for condonation of delay as required Under Section 24(A) of the Consumer Protection Act. Therefore this claim being barred by limitation the complainant is not entitled to that relief. However from the prayers made by the complainant in the prayer column it is evident that he has not prayed for any relief in respect of excess payment of Rs.2500/- made by the opposite party towards insurance premium. Except the details of the excess payment of Rs.2,500/- towards premium the other averments in the complaint are very vague. The complainant claims that he had paid the entire amount due and in spite of it, the opposite party sent the letter dated: 04.11.2008 demanding Rs.21,866.77 paise. But the date on which the entire amount due was cleared, and what is the amount paid towards full clearance of the dues is not disclosed. It appears in spite of repeated demands and requests the complainant failed to make payment of Rs.21,866.77 paise and therefore exercising the right of ‘General Lien’ the opposite party debited Rs.18,140.43 paise to his SB account as stated in Para-8 of the version. As per the terms of the Card Member Agreement which is extracted in Para-8 of the version the opposite party is entitled to exercise such Right of Lien on the amount available in the SB account of the customer who fails to clear the dues in his credit card account. If that is so, the act of the opposite party in debiting the amount available in the SB account of the complainant towards the amount due in the credit card account will not amount to deficiency in service. As such, we hold that, the complainant is not entitled to the relief prayed for. In the result, we pass the following:-
    ORDER
    7. The complaint is dismissed. No order as to costs.

    8. Send a copy of this order to both the parties free of costs immediately.

    9. Pronounced in the Open Forum on this 18th DAY OF MARCH 2009.

    Angry Harrasing calls

    Me and my family have been receiving harassing calls from HDFC BANK CREDIT CARD Recovery agents. I was jobless for 2 months, so I couldn't make any regular payment. They call me during odd hours, when I'm either sleeping or in the office. They don't talk they just call and hung up. They give 10-15 miscalls and when you callback no one answers the phone. They harassed my family member's. They talk is a very rude and abusive manner even if you're polite to them and they throw personal negative remarks on you. I just want to know what legal actions I can take against those people. I even have their voice recording in my phone which I can use as a proof.

    Default HDFC Credit Card: Charged Rs 10000 wrongly to my account

    Hi,
    I am a HDFC platinum card holder. Recently when I checked my statement for the month of Nov-09 I found that there are 6 transactions in USD charged to my account. The transactions have been made somewhere in NJ USA. I have logged a complaint with the bank but there is no response. I would request you to suggest a course of action for me to follow.

    Hi,
    I am Raghavendra. I have hdfc credit card. I havent paid minimum amount due for 2 months. But they call me and harrass and they even use swear words as third rated bastards & where the fuck are you. This is disgusting. I know its my mistake of not paying but such professional organizations using such cheap words. Its disgusting. i want to get relieved from these people. I received call from 080 67139230 and the guys name is Tilak.

    Default Hdfc credit card's unreasonable demand of name waiver amount from cibil

    Dear sir,

    i had done settlement of my hdfc credit card on 7/02/2008 with the amount rs. 12500, which i paid to them through cheques. The executive with whom i have done settlement had said that now there is no any due from my side pertaining to this credit card. As we have done mutual settlement.

    Now almost after two years, when i have applied for another bank credit card, i have come to know that hdfc had given my info to cibil and the same has not been ractified even after the settlement. Now when i have contacted hdfc customer care department on 5/01/2010 to ask if any amount pending from side for my credit card, they said that my dues are clear and there is no outstanding from my side. Then i asked reason for not removing my name from cibil, then they gave me some other department's number and told me to do followup with them only.

    When i called the lady executive on that number, she took another 10 days to inform me the actual reason for not removing my name from cibil. Atlast when i has to lose my patience, she came with new matter that bank has to charge waiver amount fees and once i pay the amount then only my name will get out of cibil list.

    It was more shocking after two days when she told me the amount, which is now rs. 17000 i have to pay (for what reason i dont know) and then only i can be thankful to them for removing my name from cibil.

    1. My only concern is that at the time of settlement nobody has come front and told me to make any waiver payment, if it has to be.

    2. If i have done fair settlement and paid all the amount then why the bank is asking for any waiver fees.

    3. Is the bank has started to black mail consumers like us by illegally not removing name from cibil.

    Please let me know what can be done with my case.

    Respected Sir,

    I have my salary A/C. in HDFC Bank and my A/C. No. is 00901050350271 and Bank issued me Platinum Plus credit card 4050282002671340 against it, by this card I have paid 25000Rs. for insurance (Birla Sun Life). I want paid this amount in three EMI so when I contact to customer care they are not consider EMI facility . So please give approval for payment term through installments because I am unable to pay this amount in one sought
