    Dear Sir

    Good morning. I have been directed by ICICI Bank to approach you regarding a dispute pending long with Bank. Kindly please go through below mail and respective mails from ICICI Bank.

    There is a long pending issue related to Credit Card which I was holding in 2006-07. There was a Transaction of about Rs 18950/- in April 2007 which was made by some third person in some Big Bazar shop by sweeping my card. As soon as I got an SMS regarding this transaction I called customer care and got it blocked as well as raised a dispute on the same through customer care as well as faxed the application to ICICI Bank Mumbai Office ref. Service request No SR22040827 on April 17, 2007. An executive from ICIC Bank had come to me on correspondence address next day and I handed over the application in person to him. Now I raised a dispute on this transaction and am approaching you for Justice and a solution based on following facts: -

    1 The ICICI Bank executive who visited me on 18 April 2007 and requested not to lodge any FIR as it ruins the Bank reputation. And said Bank has its own investigation team and process to deal such matters.
    2 As per executive the investigation report will be sent and informed to me in 60 days from the date of Application of Dispute which I have not received till today.
    3 The transaction made by sweeping my card by a third person was wrongly approved by Merchant as well as Bank with out checking Photo ID of this person.
    4 Bank as well as Merchant did not check the Photo ID proof of the person sweeping my card for such a big amount.
    5 After I raised a dispute Bank did not check and investigate the same in a proper manner. Bank has not checked and collected evidences of this transaction nor have shared any information with me till today.
    6 Bank has not collected any Video tape of this transaction from the Merchant.
    7 I kept following up with Bank about the investigation and its result but Bank has till today not sent any report nor informed me of any results till today.
    8 Bank sent third party Agents with Bouncers 3 times to my office to threaten, harass and pressurize me to pay disputed amount in 2007 end and 2008.
    9 After logging complaints with customer care regarding these Third party agents bank executive started abusing.
    10 After this These bouncers started calling me 20 times a day to harass and threaten me of my life and family. These agents also got my home phone nos from somewhere and started threatening my family as well.
    11 I again lodged complaints through customer care which the Bank did not respond.
    12 When Bank failed in its efforts to collect disputed amount from me the Bank Debited about Rs 14,683 on May 29, 2008 from my saving account (003101011997) with out any intimation, letter etc. I again raised a complaint on this transaction, but the customer care people denied to register any service request/complaint and started abusing again. The customer care executive also informed me that this amount is debited as settlement amount against my Credit card outstanding. I demanded the NOC for the same which was denied by the customer care executive.
    13 After this episode I stopped any transaction in this savings Account.
    14 I had a new saving account/Salary account in 2010 end. The ICICI Bank again debited about Rs 27,000/- in Aug 2011 and also Blocked my account which also includes an FD of Rs 50000/-. This all is done with out any prior information, intimation. Bank had put bankers lien on my Saving account which has caused a great inconvenience and problems.
    15 I have again raised complaints through customer care and online through net banking email. Not a single e mail has been replied by the bank manager.
    16 I had no other way than to write to all Top management before proceeding/approaching to Bank Ombudsman officer. But the replies and the way bank treats its clients is really humiliating and irritating. Bank is not concerned about facts, evidences and customer miseries and is least interested to listen to customer, addressing complaints and resolving any issues in mutually agreed manner. Instead ICICI Bank is more interested in using Agents/Bouncers and Threats and abuses to resolve issues. And when they fail in their motive they use Debiting from Saving Account and Bankers Lien tools.
    17 I have been harassed and threaten me and my family has been tortured a lot in these years by Bank as well as its Agents. There is no reply from bank against my basic queries and questions. Bank has done investigation, as they say, in a Biased and has favored its self interest ignoring the basic principles of Natural Justice, Evidences and facts.

    I request you to Kindly intervene in this matter and provide a solution Justice and a logical end to it. In view of the Harassment, life threatening, abusing and Blocking my accounts I am interested to demand a compensation of Rs 1000000/- from ICICI Bank as damages and applicable instructions from your highness.

    Attached is the copy of communication I have with ICICI Bank by email. I can also produce a copy of Letter/Application for Disputed Transaction raised if required. Since Bank has already accepted the receiving of this through Service request No SR22040827 on April 17, 2007.

    We would like to inform you that we make necessary investigations when a dispute request is been placed. This is carried out under great care and scrutiny.

    We have a specialized team which will make all verifications before judging the release of the dispute.

    We clarify that the lost card transaction dispute was resolved in favour of the bank.

    We inform that a credit card is a personal possession and the cardholder needs to take proper care of its safety to prevent its misuse.

    We would also like to mention that as per the terms and condition given by the ICICI Bank along with credit card, "the card member is responsible for the security of the card and shall take all steps towards ensuring that the card is not misused. In the event that ICICI Bank determines that the aforementioned steps are questionable, financial liability on the lost, stolen or damaged card would rest with the card member".

    Further, we regret to share the investigation details with the card holder.

    Due to non payment of your credit card dues as per the statement of account, you were being levied with the financial charges.

    If the card holder fails to pay the said overdue amount within specified due dates, the card member is liable to pay interest and other charges applicable thereon on the said unpaid amount.

    As an ICICI Bank Credit Card holder, you are governed by the terms and conditions of the card member agreement, under which you have authorised the bank to debit your ICICI Bank account to the extent of any outstanding amount due on the credit card that proves to be un-collectable from you, and other amount due to the bank by you in terms of the card member agreement.

    The relevant extract from the terms and conditions is set out hereunder:

    "In addition to the general right to set off or other right conferred by law or under any other agreement, the bank may, without notice, combine or consolidate the standing balance on the card account with any other account(s) which the card member maintains with ICICI Bank and its Group Companies, and set-off or transfer money standing to the credit of such other account(s) in or towards the satisfaction of the card member's liability to ICICI Bank under his/her card account."

    We further state that the bank has a bankers' lien on your account as statutorily granted and available to any bank in accordance with our rights as set forth above.

    The total outstanding balance due on your credit card as on November 25, 2011 is Rs. 77,168.28.

    We request you to make payment towards the outstanding due of Rs. 77,168.28 on your credit card account for activation of your savings account.


    However, despite having put in our best efforts to appreciate your grievance and arrive at a satisfactory resolution, it seems our explanation has not been to your satisfaction, as you have continued to escalate the issue.

    Hence, we request you to contact Mr. K. Raghuraman at external.ombudsman@icicibank.com. Mr. Raghuraman has been appointed as the external ombudsman to examine customer-issues and provide an unbiased resolution.

    We reiterate that ICICI Bank at all times acts with diligence, in good faith, and in no manner prejudicial to the interests of its customers.

    Dear Sir

    I have been instructed by ICICI bank to approach to your goodself regarding fraudulently use of my icici credit card. I am attaching the mail through which I have done correspondences with icici.

    Sir, total 10 (ten) transactions amounting to Rs. 28579/- between 10.30 - 12.30 on 29.01.2012 were done fraudulently by someone by using my credit card no. These transactions are not related to me in any manner. Out of which one MSEDCL Mahadiscom reverted back Rs. 8580/- on my request through e.mails. I had also contacted with the others where these transactions took place. Hence the disputed amount is Rs. 28579- Rs 8580= Rs 19999/-
    Sir I want to settlement this case as I am totally harassed by your Bank which has not cooperated with me.

    I am not satisfied with your reply which you have repeated number of times. Your reply is a set language where you have never clarified your stand or responsibility towards disputed amount. In your reply you have mentioned “welcome booklet ICICI bank ………………...” please provide me the copy of the same where in I have accepted terms and conditions. Hence your one sided claim is totally unjust, unfair and illegal.
    Once again I reiterated here that please clarify why I should pay the interest on disputed transactions when your bank was given instruction not ask disputed payment from me by the police authority till the investigation is going on. (Copies of the complaint lodged as well as the police reply and duly filled grievance form of your bank are attached herewith for perusal). Is your bank apex than the police authority? How I could have paid the disputed amount by not abiding the instruction of the police authority.

    It is stunning to see your reply as well as your illegal act to use your power to debit an amount of Rs . 9696/- from my existing demat account with ICICI bank which has no link with ICICI credit card. However I want some clarification on my queries from your bank:-
    (i) After complaining the fraud what action has been taken by the bank so far? Your bank could have much time to stop the online payment but bank has not taken any action, why?
    (ii) I personally contacted through email to all the agencies where these transaction had taken place and one agency namely MSEDCL Mahadiscom had reverted back the transaction of Rs. 8580/- immediately which was done by the impersonating person. Other agencies assured us to co-operate only with the bank investigation. All the copies of these e-mails forwarded earlier to your bank. Please check your record.
    (iii) That your bank have no responsibility or concern with the your client who have clean record in your bank?
    (iv) Due to under investigation the matter I could not made the payment in time presuming that bank will do some favourable action towards the disputed transaction. Why should I pay the interest thereon and please check your record where the FIR copy and instruction by the police of Aizwal where it is mentioned that not to make the payment till investigation going on. Why should I pay the disputed amount till the outcome of the above investigation.
    (v) No representative till date has come to meet me to sort out the matter.
    Finally I want that your bank depute official who well conversant with the facts of the case to finalize the matter because your all acts demoralize and harassing me from the very beginning of case. Hope positive outcome from your side.

    We refer to our earlier e-mail of August 14, 2012 regarding your ICICI Bank Credit Card.
    The disputed transactions as confirmed from our records, has been effected on your subject card. We would like to clarify, that the transactions have undergone a 3D Secure Authentication, which is a second level authentication specifically built in for online transaction done through merchant websites. It may be noted, that apart from the Card Verification Value (@@@) and Expiry date on your credit card, your personal 6 digit 3D Secure PIN was also required for effecting the said transactions.
    The 3D Secure PIN is purely personal and privacy to the customer and would not be known to anybody, unless compromised otherwise. The card holder is responsible for the security of his/her card along with his/her personal 3D Secure PIN and should therefore take all possible steps towards ensuring the safe-keeping thereof. The bank does not incur any financial liability arising out of the misuse thereof by unauthorised persons.
    We confirm, that the transactions were allowed as the system is @@@, Expiry Date and 3D PIN specific and not person specific. We reiterate, that as the transactions were qualified by information strictly personal to you, the bank is therefore precluded as per industry guidelines to repudiate the transaction with the merchant on the basis of your dispute.
    We therefore regret to inform you, that the bank will not be able to accede to your claims with regard to the disputed transaction.
    Further, for 3D secure authenticated transactions, bank does not have rights to raise a dispute with the merchant as per industry guide lines.
    Every bank in India has to conform to these guidelines as per Visa/Mastercard.
    We regret to provide the supporting documents of the disputed transactions.
    Further, the IP address used for the transactions is 115.117.236.218, we request you to take up the issue with the merchant and take assistance of police for further verification and recovery of the disputed amount.
    In view of the reasons cited above, we advise you to meet this explanation with reason and acceptance.
    The outstanding balance due on your ICICI Bank Credit Card 4477 XXXX XXXX 3022 is Rs. 19,370.47 as on August 21, 2012.
    We request you to make the payment of the outstanding balance on your credit card account to avoid levy of financial charges.

    Dear Sir,
    With reference to your letter dated 28th July 2012, it is regretted to say that without going through the facts of the case you have issued this notice which is totally unjust, unfair and illegal.
    I had various correspondences through email and speed post and telephonic calls records with your bank (copies enclosed) where I clearly mentioned that my credit card was used by someone fraudulently without my consent in the month of January 2012. When I come to know immediately I blocked the credit card and lodged FIR with police of this fraud and the copy of the same was forwarded by email and by speed post to your branch also.. From the beginning I have been facing lot of problems with your Executives because information given by them is always contradictory and I think your branches have no co-ordination among themselves. Every time, I explained the situation to your executives but all in vain.
    You may please check my earlier record where I have been paying my all dues in time and have good record in your book. But sorry to say that you have no concern what happened with your customer.. This is the way to deal with your customer to issue such a notice and debit the amount of Rs 27242.90 from my demat account No. 002901051016 without going through the facts and the FIR copy and my correspondence.. This act is illegal and unjustified.

    Please check with your Debt Manager Mr. Anish Gupta who collected the FIR copy and correspondence from my home and investigate the matter and assured me to solve the matter and said that any further call or correspondence come from the ICICI bank give their reference.
    In view of the above, I request you to kindly sort out this issue at the earliest and immediately refund the amount of Rs. 27242.90 to my account otherwise I have no option to move a complaint in the Consumer Court.

    Default Icici bank debited my saving account though my book my show transaction not complete ed

    On 20 Apr I was booking movie ticket on book myshow transaction not complete ed but myaccount is debited double amount
