Default HSBC Credit Card Annual Fee

    Hi,

I am holding a HSBC Credit Card no XXXXXXXXXXXX3857 since 2005. When I had
taken the card the executive had told me that it’s a lifetime free credit
card. However, the bank charged me an Annual Fee in its statement of
December, 2005. When I had called the HSBC help line, the HSBC executive
assured that the Annual Fee will be reversed in my next months statement.,
which they did reversed. This had happened every year in my Decembers
Statement. I used to receive a statement with Annual Fee in December and it
used to be reversed in the next months statement .

In November, 2008 I had been on a project out of India only to return in mid
April, 2009. When I saw the HSBC statement of April month I realized that
HSBC has charged me with late fee on the Annual Fee since December, 2008. I
immediately called HSBC Help Line and tried to explain them that they have
charged late fee unnecessarily on Annual Fee when my card actually is a
lifetime free card. However, there was no proper response from HSBC.

Meantime I again left for a project out of India only to return in July. To
my shock I started receiving threatening calls from the so-called Collection
Department. The person who called on behalf of HSBC Collection Department
threaten me as well as my family with dire consequences and on another
occasion another person from the same department not only threatened me but
even demanded that I should give a statement on the phone “I am not going to
pay and HSBC can take any action on me. I don’t care”. He kept on repeating
that I should say these line and even spoke to me in raised voice. On
another occassion the call from this department asked for a settlement
amount of Rs.1500/- and if I dont do a settlement they will list me as
defaulter with RBI and as a result I will face lot of difficulties.

The department is now calling me often now and disturbing peace of my mind.

I have the copy of the statements wherein they have reversed the Annual Fee
previously and also have the proof that I was not i n India when the
statement were sent to me. I also know the names of the two executives with
whom I had spoken on the help Line when I had come to India in April, 2009.

Shall I lodge a complaint against HSBC in Police Station? How Consumer Court
can be of help to me in this situation.

    Kindly suggest.
