i am using HDFC Credit Card NO. 5176 5210 0503 2026 from the past 2 years. on april 25th 2009, i lost this card but did not notice it.

i noticed the missing card on 29-04-2009 and complained to HDFC Bank Credit Card Call Centre. They informed me some body has used Rs. 47102.00 (Credit Limit is Rs. 46,000-00). I then filled up the charge dispute form and submiited to the bank. the bank reacted very late and agreed to visit the shops only on 5th may 2009. i along with bank personnel visited these 3 shops. primus retial pvt ltd bsk 3rd stage bangalore, gr colors dvg road bangalore and shree mahdushala srinivasa nagar bangalore. the person has bought items worth rs. 33000 in primus retial and 11500 in GR Colors and 3090 in shri madhushala. i collected all charge slips. the shop owners are not having any proof about the person/s who misused this card.

Then i lodged a compalint with the police and the police also visited shops along with me and found no proof. they have given a police investigation report. i sent all these to hdfc bank.

HDFC bank generated a statement now and asking me to pay up. i have approached banking oubdusman.

now what i have to do ?

can i go to consumer court for the following reasons

1.HDFC did not alert me thourgh phone/mail when the person misused the card above its limit even though they are charging over limit fee.

2.The shop keepers of primus retial pvt ltd did not verify the signature nor asked for id proof when there is a huge transaction worth rs. 32000 in primus and 11500 in gr colors. can i file a case against them.

3.GR Colors said they delete all one week old video footage and they also said if u had come one day before they would have provided video footage ? now can i file a case against HDFC Bank for not attending to the matter or not giving me address of the shops where these transactions took place ?
