ICICI Bank asking to pay for the online fraudulent transaction on my ICICICredit Card

    Post ICICI Bank asking to pay for the online fraudulent transaction on my ICICICredit Card

    Hi,

    I'm holding an ICICI Bank Credit Card since 2008.

    I've not been using this card for quite sometime. In 2010 I moved out from my local address on which card was billed. Since, I moved out my previous address became invalid though it was not updated to ICICI Bank. They have been sending statements to the invalid address where I do not know (at least person unauthorized to receive the statement) who was receiving it.

    Today (11/09/2010) I logged into my online banking account and happen to open credit card section (which I never used to open as I was not using the card) and I saw that it has an outstanding amount of Rs. 53,506.96 (card has credit limit of: Rs 43000.00).

    I traced back old transactions from online account and I see the following fraudulent transactions that I'm not aware of:

    These were all online transactions as we can see from the details. For online transactions 3D secure password is required which is safe with me (even if some one has noted down my card's other details).

    I immediatley called up the bank's customer care and inform about it. My card was already blocked due to Non-Payment of dues. Bank is not ready to register a dispute request saying that it is too late as it has been sometime now since the fraud happened.

    I would like to register a complaint against the ICICI bank. They have been delivering my Bank Statement to an unknown and unauthorized person at the first place. Causing breach of privacy and access to secret card information. The transactions were unauthorized and were done without 3D secure password, I've been not receiving statements. Now when I've realized the fraud they do not to even take a request and fix it instead forcing me to clear the due.

    Please help me with your guidance.

    Unhappy Bank not acknowledging the deficiency instead pushing to pay full amount

    Hi,

    I believe ICICI bank has taken note of my mobile and email ID and expect to here something soon. In the meantime see the below:

    I've sent emails to ICICI bank customer care and the bank is not acknowledging of the
    - deficiency in service and doing a criminal act of sharing extremely personal identity information to un-authorized and unknown persons by delivering Physical statements to them without checking their identities.
    - no email statements sent
    - no Mobile alerts received

    Still Bank is asking to pay the amount as per the bill generated. I would be unable to pay any amount given the facts above that I wasn't aware of the fraudulent transactions and bank also failed to stop it and also failed to inform me of charges on Credit Card.

    Please suggest how do I proceed, shall I take some legal recourse for:
    - deficiency in service (banking ombudsman)
    - incorrect information provided by customer care (banking ombudsman)
    - Sharing of personal information to un-authorized person without my knowledge (a Criminal Act and criminal complaint)


    See below banks Ignorance to answer questions asked when they provide incorrect information (bank's claim of delivering email statements, and delivering physical statement to me).

    As it is permanently deactivated we, are unable to reverse any charges levied on this credit card account .

    The credit card is permanently deactivated so, it is handled by the collection team .

    I request you to make payment as per the statement and avoid levy of further financial charge, which will only add to the dues outstanding. Timely payment of dues also helps maintain good track record with CIBIL.

    Before we further talk into this matter. I would like to bring your attention into some facts that you might have not checked before you sent your reply and stated incorrect, these are:

    1. I have never received any email alerts or statements on my email ID (s.gyanendra@gmail.com) until last week when I registered for email statements. Check with your departments if there were really any email statement before 12th Nov 2010 regarding this credit card.

    2. Also check, though phone alerts are not considered a credible mode of communication, the alerts bank might have sent regarding this credit card has never been received on my mobile after fraudulent transactions has happened on my card. Check with the operator you have been using to send the Mobile alerts.

    3. The most important mode of communication and which is considered a must to be delivered to credit card customer (delivery on sign by card holder), to enable him pay credit card bill, is Physical credit card statements. Which I never received.
    I'm not contesting here that bank did not dispatch the physical statement, instead that those were never delivered to me (Gyanendra Singh) instead has been kept delivering to some unknown, un-autorized person, without checking his/her identity. In turn exposing my important personal information (which indeed is a crime I suppose).

    So, before we discuss any further on this matter, please come back checking the above three details. I attribute this whole matter has happened because Bank failed to apprise me of my statements and transactions happening on my card. Since I was not delivered statements/informed of the transaction I find it difficult to enter into a settlement with bank before clarifying the above facts.

    Also, I would like you to claim that before this incidence happened in June-July,2010, you'll find me a timely due paying customer.

    I hope bank will not disappoint me and will live upto its credibility of serving the customers in best possible way.

    Now when I check online credit card details, I see I have been due to pay ~53,500 INR. This all is accumulation of fraudulent transactions and then late fees and tax on those which I was not informed by statements or other means.

    I want you to investigate the fraud and clear the outstanding from me as I was never informed by bank, statements not received by me instead delivered to unknown/unauthorized persons living at my old temporary address. Also, these transaction were not authorized by 3-D secure password by me.
