On 6th Nov 2008 at about 6 PM in Bangalore ,while travelling from my home to a market place, I was stopped by 2 people, misinforming me that there was leakage of petrol in my car. While I came out to check for leakage, the miscreants stole away my purse from the car. My purse had various important documents like passport, PAN Card, HDFC Debit Card, American Express Card, HSBC Credit Card, Driving License.

I lodged FIR at about 6:30 in the nearest Police station. I blocked all my credit cards and debit card with help of my father and Fiance. While I was blocking all other cards, my HSBC card was being misused. When I finally called HSBC to block my credit card, they informed me that it had already been used. IThe fradulant trasactions had already been carreid out amounting to about Rs 73,000.I was informed by the Call Center agent that the miscreant had tried to make another transaction from the same card, but as it had exceeded the credit limit, the transaction got rejected.

I had filed for a dispute with bank regarding this issue, informing them that I had never used my credit card.However, the bank insisted that the liability of card is on the owner and not on the bank. I asked for a simple merchant transaction slip from bank which the bank would have for the purchases being made from my card. It is a basic security measure to ensure that merchant tallies the signature on the back of the credit card with the one on merchant copy. However it seems that bank does not enforce this to the merchant and allows the transaction anyhow. This way, simple swiping of credit card allows anyone to use anybody else's credit card.I have approached the bank couple of times regarding this matter, but it has not helped anyhow

I also approahed the Ombudsman of Reserve Bank Of India to settle the matter, however they suggested that they would not be able to push the bank for interrogation. They also recommended me to seek assistance from consumer court.

SIr, please assist me in resolving this matter at the earliest.
