I was using a Manhatten Credit Card from 2006. I used to repay whatever amount I have used. Once I had even cleared an amount of Rs.72,150 on Feb 2007, in shot without opting for one-time settlement or any waivers. I was using the card after that till Dec 2007 when it got suspended due to non-payment. Even after this I was making the minimum payments each month. Recently I got a call from one of their executives as king me to opt for a final settlement and threatening me to take severe legal action against me and also harassing me and my family. Calculations from the receipts I have reveal that the amount I have used adds up to Rs.44,004/- (excluding interest, late charge fee and taxes). The total amount I have paid back as minimum balance comes to Rs.48500/-. Final settlement proposed by the executives are different with each call ranging from 31000/-, 37500/- to 41000/-. When I asked for the detailed bill they threatened me saying that I would not be eligible for the final settlement option if I go for the detailed bill. and now they are calling me every day asking me when I am making the payment. Since I have already repaid the amount I have used on the card is it not possible to close of the account or do I have to pay back all the interest, late charges and cheque collection charges e.t.c.
If I were to go for a one time settlement can I say that I can pay only such an amount or is it that I have no option but to take whatever they offer me? Who decides the amount for the final settlement? What are my rights legally? If I approach a court with the concerned documents I have with me what could be the stand taken by the court?
