Dear Sir,
I wish to lodge a complaint against a Delhi based company by the name of 'DefLink
Pvt Ltd' which deals in arranging car loans and delivery of cars from the authorised
car dealers. The company claims to assist people in getting car loans from various
banks and process the documents with the authorised car dealers to get the delivery
with one week.
I am an ex Army officer and wanted to purchase a new i10 Hyundai car through the
Canteen Stores Department (CSD). I approached the company around 20th Jun and they
promised me that through the CSD the car will be delivered within 7 working days
including processing of the loan from Kotak Mahindra.
The executives of the company used to call me up at least five to six times everyday
to ask me for the cheque of the balance amount which I was required to pay. I handed
over all the documents for indenting the car from CSD canteen as also those required
for processing of loan on 1 July 2009. On 4th July we made a cheque in the name of
the company for Rs 2,38,913/- as the balance of money after taking out the loan
amount of Rs 1,50,000/- that I was to take from Kotak Mahindra.
No sooner the cheque was handed over to them, their calls stopped and every time I
would call them up to find out the progress, one Ms Niharika (who claimed to be the
owner of the company --- but later on it was revealed that she was not the owner)
would say that it would take three more days. Then she stopped taking calls from us
and Ms Seema Negi, another employee, would tell us that the delay is from Kotak
Mahindra side. On 14 of July when I checked up from Kotak Mahindra, Lakshmi Nagar
Office they informed us that they have not received any documents from Deflink.
When we told this to the company they said that I had given only three months bank
statement where as I was required to give six months bank statement. When we queried
as to why didn't they inform us of this 15 days back they falsely insisted that they
had told us about this. Common sense says that if I could provide them three months
bank statement I could have also provided them
with six months bank statement if they had indeed told us about it. Next day I
provided them with six month bank statement but still for next three days I did not
hear from them. No calls were being taken by them and when on the fourth day Ms
Seema Negi took the call she said that on perusal of the statement it was found
that the there is a house loan EMI going from the same account from which I intend
paying the car loan EMI so it is not valid. We again asked them as to why did they
take four days to inform this they said I should have known this myself.
I gave the fresh documents of my wife's salary account and she too became
the co-applicant for loan. However still there was no progress by DefLink Pvt Ltd.
When we again contacted Kotak Mahindra bank on 24th Jul they said that they have
received some documents from DefLink one day before but the loan agreement
papers have not reached them. On 25th July we went to DefLink's office at C89 Lajpat
Nagar I (Basement) New Delhi and it was on that day we asked them to cancel our deal
with them. After making us wait for four and a half hours the supposedly owner of
the company one Mr Ravi Sharma came at 10.30 pm and said that he will ensure that
the car is delivered within three days and that we should not cancel the deal.
In the meanwhile because of the delay we started enquiring from CSD authorised car
dealers at Jalandhar, from where the car was to be collected by us, and we came to
know the following frauds being done by DefLink Pvt Ltd:
a) Since past two months Hyundai has been offering free insurance. Deflink
company had taken Rs 10,640/- from us as insurance fee.
b) The dealer was giving nine items of accessories free as promotional offer
where as DefLink had promised to give three petty items claiming that they are
giving these from their side.
c) The registration-cum road tax for Delhi was around Rs 10,000/- but the
company had taken over 14,000/- from us.
d) Kotak Mahindra web site clearly says that there is no processing charges on
car loan but the company had taken Rs 2700/- from us. DefLink is also insisting that
a fee of Rs 500/- will be charged by Kotak Mahindra for getting the loan
paid through ECS where as there is no such mention in their web site.
e) The company over and above is also charging Rs 2000/- towards their service
charges which we have no issue in paying only if the company is providing us any
worthwhile services.
Now the company has stalled the processing of the case saying that unless we pay Rs
500/- towards ECS charges the loan will not be sanctioned. I have the option
of repaying the loan by PDCs but for that my bank will take minimum ten working days
to send two separate cheque books on two separate requisitions.
We had sold one of the two cars we already had on the assurance from DefLink that
they will get us the new car within 7 days whereas its been more than a month and
the company on some or the other pretext has not delivered the car. Both self and
wife are working and are too harassed to take an auto or cab everyday to our work
place and spend huge amounts of money.. Deflink has earned the interest on our money
that we had paid on 4th July for almost one month by putting that cheque in their
account. Now they are neither returning our money despite several requests
nor processing the case for early delivery of the car.
You are therefore requested to initiate the case of fraud and harassment against the
company and get our hard-earned money back along with damages of Rs one lakh for
harassment for one month and fraudulently taking additional money from us for the
charges which were never there.
