1. We have purchased two Maruti Suzuki vehicles model Swift Dzire VDi from Sai Service Station Ltd Vide their invoice nos 1901 and 1905 dtd November 4, 2010 for the amount Rs. 618,143 each , which includes excise. (copies enclosed). It is to be noted that this dealer invoice has been invoiced on the address of A/P Kondhawale, Taluka Mulashi
2. Said vehicles were dully registered by Pune RTO with registration nos MH12 FZ 1288 and MH 12 FZ 1298. Vehicles have been duly registered as Taxi. Enclosed are registration certificates for the said vehicles.
3. Registration certificate mentions address as A/P Kondhawale, Tal : Mulashi and we have enclosed certificate of local body of Kondhawale .
4. We have also insured the vehicles with New India Assurance Co Ltd and the said insurance policy mentions vehicles as ”passenger carrying” vehicle.
5. As per Central Excise Notification no 64/2003 dtd 06/08/2003, certificate of Regional Transport Authority certifying taxi registrations as stipulated for excise refund procedure.
6. When we asked for the refund dealer informed us that the processing is done at Maruti Gurgaon factory and he has to send papers to the Maruti offices. All the dealers of Toyota, General Motors and Mahindra Mahindra have been refunding the excise upfront.
7. On submitting the papers, dealer has repeatedly refusing to forward the papers on the pretext that company do not have address at Kondhawale overlooking the fact that above mentioned invoices of dealer has same address.
8. Furthermore we wish to state that the as per the excise notification , excise refund is for the “use of vehicle” and not for the location of vehicle.
9. By denying to process the refund, dealer is contravening basic rules and notifications of excise.
