I have applied a used car loan from M/s TATA CAPITAL LTD. in the month of March 2008.through his DSA/Channel Partner M/s CREDIT ON LINE. Which were also located in Delhi.

And subsequently M/s TATA CAPITAL LTD. were generated Auto Loan Contract cum loan agreement no.7000009492 for Rs.374000/- (Rs.Three lacs Seventy four Thousand only) as loan and fixed an EMI of Rs.10857/- (Rs.Ten Thousand Eight Hundred Fifty Seven Only) for repayment of loan amount for the tenure of four years.

For this effect I have signed all the ECS papers and other documents for the clearance of the above said loan and all the ECS were continuously debited in my ICICI BANK saving account no.036701500722 every month from 03/05/2008.

But Till date the above loan amount were not reimbursed in my saving account no.036701500722 of ICICI BANK LTD.

And this fact was come to my knowledge in the month of OCTOBER 2008 When TATA CAPITAL LTD.persons came to me and told me to surrender the registration certificate of the vehicle duly endorsed in the name of TATA CAPITAL LTD.But I am unable to produce the registration certificate as till date this were not endorsed in the name of my self and as well as TATA CAPITAL LTD.

Then I have contacted to DSA of M/s TATA CAPITAL LTD.i.e. CREDIT ON LINE for registration certificate of the above said vehicle. Then they Mr.Rajender Batra/Mr.Pawan Gupta (Prop. Credit on Line) have told me that M/s TATA CAPITAL LTD. were not reimbursed the loan amount and they have not surrendered the copies of registration certificate to TATA CAPITAL LTD.

After that I have immediately closed my ICICI BANK SAVING ACCOUNT to STOP further payments to TATA CAPITAL LTD.

And after that the original buyer of the taken back the car from me as I haven’t pay the amount of the above said car.

After that I have visited the TATA CAPITAL LTD.Delhi Branch then they have told me that they already reimbursed the money to CREDIT ON LINE.

Now I have received a legal notice from TATA CAPITAL LTD. Lawyers for submitting the duly endorsed/hypothecated copies of registration certificate as well insurance policy to TATA CAPITAL LTD. or repayment of above said loan.

Now I . Which shows that the loan amount was credited in my account or DSA’s Account.

Then I have demanded documentary proof for this payment through several EMAILS as well through Courier letters and personal request letter. Which shows that the loan amount was credited in my account or DSA’s Account.
But till today I have not received any reply from TATA CAPITAL LTD.

Now, the call center executives and recovery agents call me everyday and threatened me for the consequences as well as legal proceedings.

Please help me in this matter and advised me how could get money back from cheaters. And teach a lesson to these people.
