Dear Sir,

I have been unjustly charged extra Rs. 13160 after full and final payment of my auto loan a/c no. 13948641 to HDFC bank. Due to recession hit and my salary diminution I asked for extension of the auto loan tenure from 3 to 5 years, but the bank rejected my application. As a consequence, I failed to pay the EMI of Rs. 13160 due on September 7, 2009 and was compelled to sell my car later in September which causes me a lot of inconvenience because my little 2 month daughter has to use auto rikshaws and public transport instead of travelling comfortably by car.

On September 25, 2009, I appeared at the Safdarjang branch of the HDFC bank to make a foreclosure of the above mentioned auto loan and make full and final agreement with the bank. According to it, I paid Rs. 3,15,000 by cheque. The above said sum included pending (overdue) installment of Rs. 13160. On September 29, 2009, as soon as my salary was credited to my salary account held with the HDFC bank, the overdue loan amount was debited from it and credited to loan account no. 13948641. According to the Agreement, made with the bank, in case the EMI gets recovered upon presentation, the amount thereof will be refunded by way of pay order / direct credit (through NEFT) within a maximum of 30 days from the date of foreclosure, which the bank failed to do despite my numerous requests.
According to the RBI instructions, all un-encashed PDCs should be returned to the customer at the time of foreclosure, but I did not get those cheques in spite of my request to do so.

Kindly give me a suggestion how to get my money back. I can provide a scanned copy of F&F settlement and my account statement where bank's action is reflected.
