Default ICICI bank car loan complaints

Even i have an issue where in i have taken a car loan from ICICI bank. and
while taking it they communicated a to me that 10.5% would be the interest
rate(flat). And the loan amount they have given to me was Rs225000. i also
confirmed with them that there were no other charges apart from those. As
after getting the loan approved i didn't receive any documents from them, i
called up the customer care and requested a copy of the loan agreement and
the cover note. where in after a month i have received the loan agreement
but never received the cover note. however when i checked the agreement, i
was shocked and found that the loan amount shows is Rs245000 and the rate of
interest is 11.5%(flat). And it was unbelievable that when i spoke to one of
the managers in the car loan sales branch, they says that it was my
responsibility to check before taking it and ultimately blamed on me which
is just nonsense. Somebody please tell me that is it not their duty to
intimate the customers? they are in banking sector. we are from IT. but does
it mean that we are fools?

And then i stopped paying the EMI's of my car taken and one more very
important reason is i lost my job in the meantime which i have intimated the
bank by calling them the same day. And these idiots, whenever they called
me, i have kept them informed and updated always. and now after a few months
in-spite of the fraud they did, i trusted them and informed them that i
will pay the EMI's as promised and will continue with the loan. At the same
time a few rowdies from the Bank caught me in the middle of the road and
tried to hit me and forced me mentally and physically to sign on a "ICICI
bank asset surrender document" and took my vehicle away.

When consulted the collections manager. he says that it cant be settled.
where in he says that he will auction the vehicle and i have to pay the rest
of the amount apart from the auction amount which is unfair and nonsense.

Here, kindly notice that the error and the mistake is from their side which
they are not ready to accept. In fact they are blaming the customers from
    whom they are eating.

SO ALL OF YOU PLEASE TELL ME THAT DO WE NEED SUCH BANKS IN INDIA WHO EATS
FROM US AND BITES OUR OWN BACK. THEY ARE FOOLING INDIANS.

So even i have decided to file a case against ICICI bank. As they are fraud
and cheating INDIANS, we should prove that we dont need such banks in INDIA
    at all.

I am going in full swing against ICICI bank to save all of us facing these
problems. lets see what best i can do until my last breath.

    Dear Mr. Chakraborty,

Before approaching Consumer Forum you can write a complaint letter to the Head Office of the Bank and don't forget to keep a copy of that letter with you. Wait for the response from them, for hardly 15 days and contact us again after 15 days or after getting any reply from head office. The address is:

Default fraudulently encashment of cheque br ICICI Bank Ltd

    Dated June 10, 2010
    FIRST REMINDER
    Ref: My Letter Dated 27.04.10

    To,
    The Branch Manager
    M/s ICICI Bank Ltd

    PATIALA-147001

Subject: Regarding Car Loan Account No LANAB00004546955.

    Dear Sir or Madam,

This refers to the above said car loan raised by me to finance my new Maruti Wagon R Car bearing Registration No PB/11/AC/4499 bought on 14.09.2005. I submit the following details and clarification regarding the above said Car Loan:

    1. That I had taken a car loan from your bank of Rupees 290000.00 (Two Lac Ninety Thousand Only) on 27-09-05 to be paid back in sixty equal monthly installments of Rupees 5975.00 each including interest.
    2. That I had issued all post dated blank cheques against the said loan from my saving bank account with Axis Bank Ltd at Nabha.
    3. That on 02-08-06 unfortunately one cheque No 04175 dated 01-08-06 issued by me returned unpaid.
    4. That upon bouncing of the above cheque your representative Mr. Anil Arora approached me and I immediately paid Rupees 6225.00 in cash to settle the matter of the unpaid cheque along with charges accrued on the same. He issued receipt no CL07063960623 dated 10-08-06 as final settlement of the said issue with assurance that the unpaid cheque will be returned to me within few days.
    5. That to my surprise despite paying the full amount along with penalty to your bank against the said cheque, you got encashed the same cheque on 11-08-06 which according me amounts to total and Breach of Trust.
    6. That this illegal encashment also disturbed the balance maintained in my account which further resulted in bouncing of another cheque thus hitting hard my creditability and pocket.
    7. That despite many telephone calls and visits to your branch you did not realize your mistake and thus did not refund the fraudulently encashment money from my Axis bank account.
    8. That, then I was forced to serve a legal notice to you through my counsel Mr. Vikram Shahi on 12-03-07.
    9. That on receiving the notice you partially realized your mistake and refunded only Rupees 5975.00 with barren apology letter being totally insensitive to the issue. I am surprised being a banker, wrongly encashment of cheque does not bother you at all.

Now, after gap of Three Years:

    1. I received a call from your bank that a cheque No 64237 dated 01.02.2010 has bounced so please visit our branch and make the payment of the bounced cheque at the earliest alongwith the interest thereof.
    2. I enquired the matter from my banker i.e. Axis Bank Ltd Nabha about the said bounced cheque to which they said that it has been returned unpaid due to technical reasons as the amount written in figures and words differ from each other.
    3. When I again received the call from your bank to pay up the Feb’10 due installment, I clarified the matter with a request that please do not use the word “your cheque bounced” etc as the same has been returned unpaid due to no fault of mine as the blank cheques were given to you and the bank fills the details in the cheques.
    4. I further requested that since I had a very bad experience with your bank so kindly return my cheque and I will make payment there and then.
    5. To which the caller from the bank side plainly refused and kept on insisting to make the payment.
    6. I further requested that if you cannot return the cheque then please give in writing that the bank will not present the cheque again in my bank, which also resulted in blank refusal.
    7. I have made clear several times to the different callers from your bank including the senior manager of the calling bank Mr Umesh Khanna that I cannot make the payment without getting my cheque back or getting the same thing in writing that it will not be encashed.
    8. That now the caller bank has started harassing me by making calls at any time of the day and repeating the same thing again and again thus totally disproving your main slogan “We Value your relationship with ICICI Bank”.
    9. A further request to either give branch telephone no or asking the branch manager or some branch executive to call and sort out the matter has also fallen on deaf ears.
    10. That now the latest calls say we will penalize and debit extra interest for not making the payments and also give adverse creditability report relating to the said account.
    11. That your callers are not aware of all these facts of the case as they say all this is not reflected in the system thus clearly indicating one side of the story.

    Now my question is:

    • That if you make yourself entitled to collect penalty on unpaid cheque why you should not be penalized for fraudulently encashing the cheque from my account?
    • And if you are charging interest on the amount outstanding towards me then should not the same principal be applied to you for withholding my money for eight months?

These double standards maintained by you itself indicate the respect and relationship you carry in your heart with your clients. Hence a humble request is made to you, to use your good offices to sort out this matter and also develop some system so that these types of problems are tackled to avoid wastage of energies.

Perhaps before you value the ‘relationship’ with the customer you need to value the ‘customer’ itself.

Still hope for a positive thinking to prevail.

    Default Car loan complaint

    Sir,
i am taniya gaba. I took a car loan from your bank.my lan number is ladel00012203302. I am very unsatisfied with the working of your bank.
All the installments went on time. The last installment was of rs 1 lac. The amount debited from my account on 10th of every month. The last installment of rs 1 lac did not debit.
I called up customer care to enquire about the issue, the said that your cheque has been dishonoured due to lack of funds. The balance in my account on that date was rs 565689.
Constantly getting calls from your bank officials , they told me to issue me a cheque again , i said ok but give me in writing that it is the icici bank fault and not my fault and no extra charges will be levied on my amount of rs 1 lac.they said they could not give me this in writing but do trust us that no interest would be levied and whole conversation is being recorded . I issue them a cheque again and the amount got debited from my account.
Thee was no response from your bank side regarding noc of car.
I called up again o enquire about the noc they said that an amount of rs 1200 is stil due from my side( late payement interest)...i said it was not my fault , your officials said its your fault.
I had a word with mr amol, he enquired about my matter and checked that its the bank fault and not yours and he assured me that he has waved rs 1200 the interet charges and gave me a noc request no. The request no was sr1664323321. He called me up himself saying that sir your request is being processed and by saturday you will receive a sms and within a week you will receive the noc.
Its been more that 2 weeks i clled up bank again and again they told me about my charges of rs 1200 and till i pay the charges i wont receive noc.
If whole conversation is recorded than why does your bank take any action. Why did amol gave me a request no than ?
I am very upset with the bank behaviour & never wish to get back to you for any loan requirements and neither suggest anyone for loans to your bank.
    Thanks and regards
