I insured my car (SWIFT VXI)on 16th Jan 2010 from HDFC ERGO Insurance company. I gave there executive a cheque and he gave me a temporary hand filled form as an temporary insurance and told me that i will be getting the original Insurance at my home adrress through Courier. I got the original insurance on 31-Jan-2010 at my address. Now on 11-Jan-2011 i was robbed on DND Flyway and the robbers took away my car, Gold chain, Cell phone and some cash. Firstly i faced lot of issues for Lodging and FIR. Now when the FIR has been launched and i tried to register my Claim with the Insurance company and they say that they have already cancelled my Insurance because the cheque that i gave to them was not cleared. I checked in my Bank Statement and found that the insurance company submitted my cheque in the bank on 26th jan 2010. The cheque was not cleared due to insufficient funds. The issue here is i gave the cheque on 16th Jan and the company submitted my cheque on 26th Jan. Even if the cheque was not cleared on 26th Jan 2010 they mailed me the Original insurance on 31st Jan 2010. The insurance company never ever intimated me that my cheque was not clear and i was under impression that my car was insured. Also in the insurance my home adress is not correct and the Engine No. of my car is also not correct.

Please suggest me whether i am elgible to launch a case on them or not??.
