Default Insurance claim not paid & file closed now...

    Hi,

    PLS HELP!!!!!

I am attaching the first formal complaint logged with this company and subsequent escalation. Now they sent me a letter saying my file has been closed due to non complaince and no response from my side???

ALL THESE E-MAILS HAVE BEEN SENT TO THEIR DELHI & MUMBAI VIA POST -COURIERED

    Dated: 17 March 2009

REF: Claim No.: 310300/31/07/01/90000699 Srl. No.: 1
    Policy No.: 310300/31/07/01/00003697
    Insured: Mr Rakesh Dhar
    Vehicle No. : DL – 8C – G – 9129
Date of Loss: 05 Feb 2008

    Dear Sir/Madam,

With all due respect, I would like to highlight my concern with respect to my claim pending since more than a year now under Claim No.: 310300/31/07/01/90000699 Srl. No.: 1

Twice In last one year I personally visited the Bombay Life Building office of "The New India Assurance Company Limited". First time was last year in the month of May and I was asked to go home and given assurance that the cheque would reach my home address by post.
This year I again visited the same office and met the same gentleman [Mr. Malhotra] and this time I was told that the duplicates have been resubmitted [as got delayed; beyond my comprehension?] and now no formalities are required and was again advised to wait for the cheque by post; which never arrived.

Now, I am in receipt of two identical letters [original & reminder - dated 24th Feb & 5th March 2009] sent to my home address by your office [Cc to Monika Arora, Saraswati Vihar, Delhi] and the content of the letters is very shocking and disappointing.

I have been asked to submit the following for processing my application and that after a gap of 1 calendar year:

    1 Claim form duly completed
    2 Driving license
    3 RC book
4 Previous Insurance policy with no claim bonus certificate

Now, can someone help me understand the reason (s), motive and intent of such communication? I do not see any value in filling up the form again; where is the original form? If misplaced, am I going to suffer for other people’s incompetence or lack of intent? Who is responsible for this delay; is this how customer service industry functions?
How was survey done? Who and on what basis was my claim give go-ahead as it was then only that “Samara Hyundai” repaired my Car?
All documents were submitted and I have seen them myself in a file in your office!!!
I also wrote down my bank account number on the same file; as advised by Mr. Malhotra!!!

All this has caused me great mental trauma and I do not see any value in visiting your office [taking leave from my work] again until a responsible person from your organization demonstrates positive intent. I am open to submit documents; but the way this case has taken shape...., I have lost trust in the functioning of this particular department and hence given birth to this e-mail which will save me my valuable time and pain.

    Thanks to respond!

    Sincerely

    Rakesh Dhar

Next I mailed to the Chief Manager - Grevience cell of this company:

    ======= quote=====

    Dated: 29 March 2009

REF: Claim No.: 310300/31/07/01/90000699 Srl. No.: 1
    Policy No.: 310300/31/07/01/00003697
    Insured: Mr Rakesh Dhar
    Vehicle No. : DL – 8C – G – 9129
Date of Loss: 05 Feb 2008

Subject: Concern regarding – REF-: Claim No.: 310300/31/07/01/90000699 Srl. No.: 1

    Dear Sir/Madam,

I am in receipt of an unsigned letter, as such unauthentic & invalid, from Sr./ Div. Manager dated 18 March 2009; wherein it has emphatically been remarked that the relevant file is not possible to be kept open for indefinite period of time and in case nothing is heard within seven days of receipt of this letter, it shall be presumed that you are not interested in claiming from us and we shall close the relevant file.

With all due respects, I have already highlighted my concern with respect to my claim pending since more than a year now under Claim No.: 310300/31/07/01/90000699 Srl. No.: 1; through E-mail dated 17 march 2009, with a copy by courier service in confirmation.

I have been directed to submit all relevant papers again in abinitio after lapse of more than a year, when all these documents stand submitted which I have also seen myself in a file in your office. I also wrote down my bank account number on the same file; as advised by Mr. P.K.Malhotra of your office!!! The contents of this unsigned letter, therefore, is bereft of jurisprudence and seems prima-facie case of mala-fide intentions.

All this has caused me great mental trauma and I do not see any purpose in visiting your office again until a responsible person from your organization demonstrates positive intent. I am open to submit documents; but the way your office has responded, I have lost trust in the functioning of this particular department.

    Thanks to respond at earliest!

    Sincerely
    Rakesh Dhar
