this is ritesh shethia. i am into transportation industry. my vehicle met with an accident on NH. after the spot survey was done i brought the vehicle to my ( local ) garage in Mumbai where the insurance company sent the surveyor for assessment of the loss and their liability. the surveyor did not come himself instead asked his assistant to carry out the procedure. his assistant came clicked photograph and went. when contacted the surveyor he told me to carry out the repair work and we will settle the claim after the work is carried out. i completed the repair work and called the surveyor to come and settle the claim. but again he did not come and asked his assistant to click the photograph. his assistant came and went away after doing the same. after this i again called up the surveyor and asked him when should i come for for settlement. but again he gave me the reason that the spot survey report has not yet arrived hence he will not be able to settle the claim. hence i waited for some time. after a few days while i was in continuous contact with him he prepared the the final report and i should see the file and the claim amount in the insurance co. office. after visiting the insurance co. office i found that the amount was to less. i contacted the manager and he told me that he will send the file back to the surveyor and i should contact the surveyor again. but the surveyor without contacting send the file back to the co.
hence please let me know the following things.
1) is this attitude of the surveyor valid.
2) what are the rules to be followed by surveyor while settlement.
3) what is the procedure in the case there is a dispute with claim settlement. please help me out.
i have not yet submitted the bills for repairing work carried out. as i have repaired my vehicle in the local garage i have give him the payment of rs 85000 by cash. when contacted one of the known person in insurance he suggested me that you should submit the bill along with cash vouchers. after the submission th bills will again go back to the surveyor who will asses the bill and send it back to the company. after this the co. will prepare the voucher and send this to us. so this is the point where i should not accept the voucher and fight with the co. for less amount given by surveyor. the benefit of this is that by preparing the voucher the co. and surveyor have accepted the claim and will have less chance to reject on any other ground. do suggest me that is this the right way to go forward with the claim.
