Dear Airtel / Whomsoever It May Concern:
This is my final correspondence to Airtel as per their Grievance Addressal method mentioned in Airtel website. Need your immediate attention to this matter as this is going on since last one and a half years. I have reached honourable Consumer Court as this issue has not been resolved satisfactorily and Airtel has been making a mockery of the grievance redressal mechanism.
The details of my complaint are mentioned below, in case you have any difficulty in locating my numerous earlier complaints in your own records:
1. I have a landline / broadband connection from Airtel for over last couple of years for my telephone no. 0761-4014759 and address mentioned below.
2. My alternate contact number is 9630741665. My contact details as well as my residence address are correctly mentioned as per your billing records.
3. I had been charged excess billing towards Airtel PC Secure since July 2010 at the rate of Rs. 85 every month, which has been brought to your notice through telephonic complaints vide complaint number 6467612 and numerous follow ups on this complaint over telephone and email communications.
4. When there was no update even after a promise of a response in a few working days, I followed up Airtel to investigate status of my complaint. I was informed that my complaint has been (incorrectly) closed with a token reversal which has taken place only from Oct 2011 just for a couple of months.
5. The total outstanding excess charges that have been charged to me and which needs to be refunded are for the remaining 15 months, from July 2010 to Sep 2011, i.e. 15 x Rs. 85 = Rs. 1275, excluding applicable interest and other charges for this period. Regardless of this, I paid all my dues.
6. The act of over-charging the consumer for a service (of PC secure), which was never sought nor provided, amounts to negligence and fraudulent financial practice and cheating causing wrongful personal loss to me, as well as deficiency in service in satisfactory resolution of consumer complaint.
7. Please consider this email as my final notification and request to resolve this dispute amicably in a satisfactory manner. In the event of a non-settlement of this dispute within the next 5 working days, I am prepared to evaluate my legal options, including approaching honourable Consumer Court.
8. Please note that I am a senior citizen and it is morally incorrect on your part to make me run around for resolution of one complaint. Despite informing Airtel about it, it has caused me harassment and mental agony in numerous complaints and its follow ups and your extortion calls to me for making payments. I would like to claim compensation towards this nuisance as well. Please let me know my options available that I am eligible to claim towards this issue.
9. As a reply to my last email, I have received a ridiculous response from Airtel Customer Service that you are unable to process your request as either my mobile mumber is not mentioned in my email or the mobile number mentioned is not in the correct format. I fail to understand that when your staff can reach me on my mobile at their will for various promotions and other follow ups, then why can't they reach me on the same number for resolution of a complaint!
10. Please note that my complaint is for my landline and not the mobile connection. I had duly provided my landline number in my earlier complaints in the subject line as required. In any case, I have also mentioned my mobile number clearly in the subject line in this email. Please let me know if this will suffice.
11. I have not received any positive response from Airtel or any of its representatives. The only reply I get is that Airtel has reversed excess charges for 02 (two) months only, while over-charging me for 15 (fifteen) months for this service, which was never sought nor provided in the first place. And what's absolutely shocking is that I have been over-charged again in this month's latest bill (Dec 2011)!
12. I believe that I have provided you with all the relevant information. The remaining information should be in your records as per complaints details mentioned above. Please do not hesitate to contact me in case you need further information or any clarification. Hoping for an early resolution of my complaint.
Your negligent and fraudulent practices amounting to cheating, causing wrongful personal loss to me, as well as deficiency in service in satisfactory resolution of my complaints and your repeated attempts of cheating me, instead of resolving my grievance, leave me with little choice but to proceed with my legal options. I wish you had the good judgment or compassion to resolve it between us, but you failed me.
I have waited long enough for you to find a rightful resolution, but your over-charging me again for the same along with a late fee (when I have paid all my dues in full) again in your last bill makes me believe that you are not serious about looking into my grievance. I had given you 5 working days' time, but since you have made a mockery of the consumer grievance redressal, I am approaching honourable Consumer Court.
