    Angry Tata Broadband- legal notice

    Respected Sir,

    In month of march i booked broadband-tata through an executive. After that i came to know about airtel connection so i told tata executive that i do not want tata connection.But at that time he told me that "madam kindly take connection otherwise i have to pay 1100 rp to company". i told him that it is not my concern. But he forced me and told me that take connection use it for 15days then i will pay your bill of 15 days and get connection canceled. after 15 days i was using airtel. and i thought that he canceled connection. But i received a Bill from tata so i made complain to customer care regarding this issue and then they told me that now your connection is canceled and you will not have to pay. But now after 4 months they have send me legal notice that i have to pay 1200 rp. My question is why should i pay if i haven't use their connection? 4 months what they have done? is this a way to treat and cheat customers? kindly help me to resolve this issue.

    Tata Has Also Send Me The Same type of legal notice for the amount which i m not liable to payoff
    what did happened after the legal notice in your case...?

    Hello,
    I'm writting this email to you in order to inform you about the harassment and cheating which has been done to me by your tatphoton plus team.me my mobet
    My name is Subhramanyu Mishra, I'm based at Bangalore, Karnataka, Last year I have enquired about tataphoton connection and get it on 23rd of July only after getting false commitment from one of your executive who came to my place with the Photon Plus device. I have paid him 1850 towards purchagin of the datacard after getting convinced and assured by your executive who assured me that In my place I will get a minimum speed of 2MBPS to 3.1MBPS. he has also promised me for a complete refund of my money if I am not going to get that much speed at least, after getting his assurance I purchase the device by paying 1850 INR and the executive configured it at my home, I have noticed right after the configuration that the speed is only 100- 200 KBPS and asked for clarification from the executive about it, and he told me after mid night I will get the actual speed and left my place with the money giving me the datacard. The very next day I tried login to the device and notice that the speed is never going above 200KBPS, and this had been continued for almost a week I checked everyday the speed to ensure whether I'm getting or will get the speed assured by your so called executive, but after 7 days of long try I give up and called your customer care on 30th July asking them to disconnect my connection and for a full refund of my money which I have paid towards purchasing the data card and also mentioned to deduct the amount of my usage from the datacard value, but right after giving the call and asking for cancellation of the photon plus account I never heard from your team again, and every time they just keep on sending me monthly bills month after month and I always sent them the copy of my complain and told them that Ihave cancelled it on 30th July so there is no way you can bill me for the august, september etc, cause that really doesnot make sense because I have disconnected the connection on 30th July..
    Everytime after sending my initial complain I never get any more reply to it neither nobody from your team came to my place to take the card back and pay me my device purchase money which I have paid as it was of no use to me. After following your team for several months I never ever get any more reply rather than the monthly bills and excuses everytime.. so laterally I pissed off and post online on consumer forum about this incident and the irony is even after getting my several emails where I have clearly mentioned about the disconnection on 30th july I keep on getting false monthly bills. I have also spoken to one of your executive who was good enough to track my cancellation request in the system and confirms that it was made from my end on 30th July.. so there is no way I am liable to pay August, September bills and it's just the false bill with out any connection of usage.

    And the irony is just Yesterday I have got one legal notice from Incuria Law Chamber to make a payment of 100 + 500 of legal charges, which is completely ridiculus as with out any usage how can a service provider like tata photon cheat innocent people like me and send send legal notice to force pay the amount which I have never supposed to pay as there was no usage from my end. instead I am trapped as I have purchased the card by paying 1850 and after 7th day I cancelled it because of the very very low connection speed, And to a proof of this I have several chain of email communications between your team and me about this matter and also I have posted online on Consumer Forum about this incident, but now after getting this Legal notice I have lost all of my trust on a service provider like Tata. So this is a sincere email request to you please look in to this matter personally and take back the legal notice and also please help an innocent customer like me for keeping a long term successful business relationship going forward.

    Below are the details about my Photon Plus Connection for which I have received the legal notice yesterday.

    As per my discussion with the executive from your support team, she has never told me anything about refunding the card value which I have paid towards purchasing it by the false promise of your executive I spent 1850 Rs to buy this crap and got promised orally by your executive who came to my place for installation that I will get 100% money back if the speed will be less than 3.1 MBPS, and I have tried for more than 4 days from 23 till 27th July to and apparantely on 30th I have request for a cancellation by calling your support desk.. and even told them to refund my money deducting the billed amount of the days I have used the connection and take the datacard back, after sending number of emails I never heard back from your team again about it only month by month they keep on billing me for something which I was not even using since 30th July, as that was the date when I specifically told the support desk to disconnect the connection with in next 24hours and get me back my money deducting the billed amount from 1850. I have noticed she has closed the support ticket with out even proper resolution of my queries and by avoiding my questions regarding the connection. so the resolution is never done for the support ticket as I have my unanswered questions for Tata Indicom which were not at all addressed during the discussion.
    But your support desk or neither of your executive took it seriously and as per my last discussion with your executive they have never disconnected the connection which was no way my fault instead your team member's. Upon my several request you guys never sent a single person to my place and the executive from TECHNO GLOBE on your behalf who gave the connection to me not even bothered to pick up my calls, I tried calling them 100's of time asking to come to my place to take the data card back but even though the executive promised me for 100% refund he never showed up after day of installation and neither come to collect the card and pay my money.. so after trying every possible sources to reach you guys and failed I finally decided to post it on consumer forum and did the same on 4th of August. now the fact is when somebody gave a request for cancellation on 30th of July for your service how can you bill him for August and September month. and what about the money I spent to buy the crap so called data card.
    Now instead resolving this matter you guys have sent a legal notice to me and yesterday I have got a Prelitigation Dispute from Lok Adalat, Bangalore, which is not at all a very good business practice for a brand like Tata. please look in to this matter and take back the prelitigation Dispute from lok adalat and advice me how we both parties can save time and effort by mutual open discussion on this matter ASAP , I am open for any suggestions,
