    The appellant is the 2nd opposite party/dealer in OP 75/04 in the file of CDRF, Idukki. The appellant is under orders to pay to the complainant a sum of Rs.41,890/- towards compensation and the 1st opposite party/sub dealer is directed to pay Rs.4,000/-. The complainant has also been permitted to continue the ownership and possession of the vehicle.



    2. The case of the complainant is that on 21/2/04 he purchased the Hero Honda Ambition Motor Cycle from the 1st opposite party. Subsequently it was found that the vehicle sold was not a new one. It was the vehicle manufactured in the year 2002 and he sought for the replacement of the vehicle or refund of the amount paid. The 1st opposite party contended that the vehicle was sold at 8 pm on 25/5/04. The vehicle was brought from the 2nd opposite party dealer on 25/2/04 and immediately the same was delivered to the complainants. The vehicle was brought by the road at 8’ O clock in the night to the place of 1st opposite party. The complaint was made after 20 days of delivery and registration. It is pointed out that the vehicle was not registered previously.



    3. The 2nd opposite party dealer has contended that there is no privity of contract between the complainant and the 2nd opposite party. According to them it is the 1st opposite party who is responsible. The vehicle was manufactured in the year 2002. According to them they sold the vehicle to the 1st opposite party. It is also pointed out that the discount of Rs.4,000/- was given to the 1st opposite party and the same was sold for sum of Rs.41,890/-.



    4. The 3rd opposite party manufacturer has contended that the 1st opposite party is not their authorized dealer. It is the 2nd opposite party who is the dealer. It is admitted that the vehicle was manufactured in June 2002.



    5. The evidence adduced consisted of the testimony of PW1, Exts.P1 to P7 , DWs 1 to 4, Exts.R1 to R7 and Ext C1.



    6. As mentioned by the Forum it is seen that Ext.R3 the sale certificate in the name of the 2nd complainant is issued by the 2nd opposite party /dealer. In Ext.R3 the year of manufacture is mentioned as 2004. Ext.R2 temporary registration certificate is also in the name of the 2nd complainant. Hence it is evident that the 2nd opposite party was aware of the entire facts. It is also found that Ext.R4 copy of the general ledger of the 2nd opposite party and a number of vehicles were sold by them to the 1st opposite party. Hence evidently there was a standing arrangement between the 1st and 2nd opposite parties. It was also pointed out that the 1st opposite party has closed down his business. Nothing was produced to show that the 1st opposite party is the dealer of the 3rd opposite party manufacturer. Hence it appears that the 2nd opposite party sold the vehicle manufactured in the year 2002 as if it is manufactured in the year 2004 to the complainant through the 1st opposite party. The involvement of the 2nd opposite party is evident. In the circumstance the finding with respect to the liability of the 2nd opposite party is correct and no interference in this regard is called for.



    7. As pointed out that the counsel for the appellant the direction to pay the purchase price of Rs.41,890 to the complainant and also permiting the complainants to continue in ownership and possession of the vehicle is some what unjust. In the circumstance the order of the Forum in this regard is liable to be modified. In the circumstances the direction to pay Rs.41890 is reduced to Rs.32,000/- and the 2nd opposite party would pay Rs.32,000 to the complainants with interest at 12% per annum from the date of complaint. The rest of the order of the Forum is sustained.

    In the result the appeal is allowed in part as above.

    Angry New bike comes with Engine Problem in 2 Months!!!

    Hallo,
    I bought a new Hero Hodna Glamour bike last two months back. I given my bike to second Free service on last 13th Janaury before Pongal. I called that service workshop people from the last monday(18-10-2010) onwards. They had not replied properly and told to do the Engine repair work.
    In this two months which Engine part is repaired???

    Till now they serviced my Glamour bike. Not yet ready means all HeroHonda Products are like this????

    How i can get my bike from that service centre?

    This is their good service and worth products from the HeroHonda?

    This complaint coming up before us for final hearing on 24-11-2009 in the presence of Sri S. Satyanaraya, Advocate for complainant and 1st opposite party remained absent and set exparte, Sri Ch. Ramesh, advocate for 2nd opposite party, Sri M.V.S. Rao, advocate for 3rd opposite party, upon perusing the material on record and having stood over till this day for consideration, this Forum made the following:

    O R D E R

    Per Sri T. Anjaneyulu, President:-

    This complaint is filed U/S. 12 of Consumer Protection Act, 1986 by complainant seeking directions on the opposite parties to deliver gold ring weighing about 2 grams and ‘C’ book and for payment of compensation of Rs.5,000/- apart from legal expenses.

    The brief facts of case are that: The complainant purchased a Hero Honda (splendor) bike from 1st opposite party. The 2nd opposite party delivered vehicle as per their rules and regulations to 1st opposite party. The 1st opposite party also offered finance facility to complainant through OP3. Complainant paid required amount as per condition of OP3. Further, complainant also paid all instalments without any due to OP3. It is further submitted that Hero Honda Company offered Gold ring weighing about 2 grams as a free gift during Dasera festival to the purchasers of vehicle. The 1st opposite party and 2nd opposite party did not deliver gold ring to the complainant as per their promise. The complainant demanded several times about the same. They postponed the matter on one or other pretext saying that they did not receive the same from their head office. The complainant also waited for sufficient time but there was no response. The OP3 also issued hypothecation termination letter on 19-10-05 to complainant for transfer of vehicle in his name, but opposite parties did not handover the original ‘C’ book after termination of hypothecation, the 1st opposite party states that ‘C’ book was in the custody of OP3. Thus all the opposite parties failed to handover ‘C’ book and as well as Gold ring. The 2nd and 3rd opposite parties received notice, but gave reply shifting the burden to each of them. Thus there is deficiency of service. All the opposite parties are jointly and severally liable for delivery of gold ring with ‘C’ book and also compensation amount as prayed for.

    The 1st opposite party remained exparte. The 2nd opposite party filed its version denying all allegations made in complaint in formal way and called upon complainant to prove them strictly. Further, it is submitted that no transaction took place in between complainant and this opposite party. Therefore, question of deficiency of service does not arise at all. This opposite party delivered Hero Honda Motor bike as per instructions of Hero Honda Company to 1st opposite party. At the time of delivery of vehicle as per the offer made by Hero Honda Company, this opposite party handedover gold ring to 1st opposite party. Hence, question of postponing delivery of gold ring does not arise at all and this opposite party delivered gold ring to their customers at the time of delivery of vehicle itself, non delivery of gold ring to complainant does not arise, which has to be delivered by 1st opposite party. Till receiving of notice from complainant on 30-08-06 they are not aware of the said fact. The complainant also never informed about the same at any point of time. This opposite party is unnecessarily added in this complaint; as such there is no relationship of customer and dealer. This opposite party does not know about terms they agreed, hence question of returning ‘C’ book by this opposite party does not arise at all. Hence, the complaint is liable to be dismissed with costs.

    The 3rd opposite party filed its version denying all allegations made in complaint. It is submitted that complainant approached them for financial assistance for purchase of two wheeler and paid all instalments and obtained ‘no objection certificate’ and also hypothecation termination letter. It is false to allege that they are in possession of original ‘c’ book of complainant and it is no way liable to return the same. It is no way concerned with the alleged gold ring and the offer made by Hero Honda Company. It is not a necessary party. The allegation that this opposite party is in possession of ‘C’ book relating to vehicle is not delivered is not at all true and correct. This Forum has no jurisdiction to entertain this complaint against this opposite party. The claim for damages is untenable. Therefore, it is prayed to dismiss the complaint.

    Bothsides have filed their respective affidavits. On behalf of complainant Exs.A-1 to A-6 are marked and on behalf of OP2 Ex.B1 is marked.

    Now points for determination are that,

    1. Whether opposite parties have committed deficiency of service?

    2. Whether complainant has entitled for gold ring weighing about 2 grams and as well as original ‘C’ book apart from damages claimed? If so, against whom?

    3. To what relief?

    POINT No.1:- As seen from above referred pleadings, there is no dispute about purchase of vehicle by complainant during Dusera Festival for which Hero Honda Company offered a gold ring weighing about 2 grams to boost up their sales. The 1st opposite party is Rudrananda Motors at Prakasam Road, Tenali from whom complainant purchased vehicle as seen from Ex.A-1 delivery challan and receipt vide Ex.A-2 dated 27-10-03. The 2nd opposite party is proprietor of Associated Auto Services, Guntur, which is main dealer for sale of Hero Honda’s and had a tie up with dealer at Tenali in the District of Guntur as per permission of Hero Honda Company. The complainant took financial assistance from Ashok Leyland Finance, Tenali (OP3) for purchase of said vehicle by paying initial amount of Rs.10,077/-, complainant has also repaid entire amount in monthly instalments. This is also not in dispute. The 3rd opposite party also gave ‘no objection certificate’ for cancellation of hire purchase endorsement made in their favour and gave letter to that effect to the Regional Transport Officer on 19-10-05 vide Ex.A-4. They have also given notice of termination of agreement of hire purchase in form No.35. This is also not in dispute. There is also sale letter dated 29-10-03 issued by 2nd opposite party in the name of complainant which is in printed proforma. The dispute in between the parties is about non delivery of gold ring weighing about 2 grams as promised by Hero Honda Company to their customers at the time of purchase of vehicle and original ‘C’ book. Surprisingly, 2nd opposite party filed a document dated 25-11-03 vide Ex.B-1 to show that gold ring weighing 2 grams is delivered by 1st opposite party. This document is disputed by complainant. According to him, if OP2 is no way concern, as there is no transaction in between complainant and itself, how he could file this document purported to have issued by 1st opposite party. It is replied by learned counsel for 1st opposite party that they have secured this document from 1st opposite party, now 1st opposite party is not in scene since he closed down his business and remained exparte. On keen examination of Ex.B-1 it is found that one D.V. Krishna Rao, the model/colour is noted as Splendor black, Engine No.03K15M46932, Frame No.03K16C44101, beneath these particulars it is observed that ‘Received gift gold ring with thanks’, by the side of it in hand written that two grams gold ring. If according to 2nd opposite party it has delivered vehicle along with gold ring to 1st opposite party, why it was not delivered to customer on the date of sale itself i.e, on 27-03-03. The learned counsel for complainant has argued that though they have delivered vehicle on the date of purchase, 1st opposite party postponed delivery of gold ring on the ground that it has not received from the main dealer, as such, he was seeking time and subsequently the document under Ex.B-1 is created which is filed along with version of OP2.

    Further, OP2 in his reply notice denied the allegations made in the notice of complainant vide Ex.A-5 and states that as per order of Hero Honda Company, it has delivered vehicles to OP1, as such it is no way responsible to parties who have purchased vehicles from 1st opposite party. Further it is stated that now OP2 has no dealing with 1st opposite party. This reply vide Ex.A-6 is given on 25-09-06 to the legal notice got issued by complainant on 11-09-06. Surprisingly, it is seen that there is no specific allegation about delivery of gold ring along with vehicles when supplied by OP1. Therefore, it is not proper on the part of OP2 to claim that it is no way concern with transaction in between OP1 and the complainant, having delivered the vehicles as per instructions of company. It is also equal responsibility of OP2 to see that gift offer made by company is properly distributed to its customers. On the other hand, it tries to absolve from its responsibility since OP1 closed its business and remained exparte. When OP2 has no dealing even by the time of its issuing reply notice to complainant how could it file the document under Ex.B-1 along with its version on 28-08-07. This clearly establishes that they are playing foul game throwing responsibility on each other.

    Further, complainant has rightly complained that the original ‘C’ book is not delivered to him, even after discharge of debt amount to financier. At the time of purchase the vehicle was hypothecated with OP3. Subsequently, it has given no objection letter to the Regional Transport Office for transferring vehicle in the name of complainant, the original ‘C’ book also deliberately suppressed. Of course, OP3 fairly submits that he is not in possession of the same and he is having no role to play therein. This is to be accepted in view of no objection certificate given by him and no purpose would be served by retaining it by OP3. Thus, we observe that there is deficiency of service on the part of both opposite parties 1 and 2.

    POINT No.2:- The complainant went round number of times to the shop of OP1 demanding for gold ring, but there was no positive response from him and also it appears that he had a scuffle with him, as submitted by learned counsel for complainant. According to him, his client also lodged a police complaint against OP1 long back certainly this would cause mental agony to complainant who is a public servant. Therefore, he deserves to be paid suitable compensation apart from entitlement of gold ring weighing 2 grams and original ‘C’ book.

    In the result, the complaint is allowed in part in terms as indicated below:

    1. The opposite parties 1 and 2 are hereby directed to handover gold ring weighing about 2grams as offered by Hero Honda Company to the complainant and also original ‘C- book’.
    2. Further the opposite parties are hereby directed to pay compensation of Rs.1,000/- for mental agony, pain and suffering and legal expenses of Rs.1,000/-.
    3. The aforesaid order shall be carried out within a period of six weeks from the date of receipt of copy of order, failing which the amounts ordered in item No.2 shall carry interest @ 9% p.a. till the date of realization.

    Dear Sir/Madam,
    I had purchased Hero Honda Super Splendor on 31st August 2009 from NIKHI MOTORS, 212, Bellary Road, Sadashivnagar, Bangalore-80. Engine NO: JAO5EA99HO3112, Chessis NO: MBLJA05EE99H03220. After purchasing this vehicle I faced with some problems. Its handle is shaking when one person drive and with two its shaking very badly. Few of my friend drive this vehicle, they are also agree with me. Then I inform Nikhi Motors Servicing Centre, they told me Its a new vehicle so it is normal, Its no problem, after a week it will atomatically solved. But still it not solved. In a month I went there five time, they told in first servicing they will solve my problem. At first servicing date(17/10/09) I told them about this problem they drive my vehicle and told me it is normal, your bike has no problem every two wheeler shakes like your vehicle is shaking. They are not trying to understand my problem, my bike is shaking very bedly. It is not fit to drive but they told me it has no problem.
    After that I moved Kolkata with my vehicle. For Second servicing(04/02/2010) I went VINLINE MOTORS, Narayantala, Baguiati, V.I.P Road, Kolkata-59. I told them about this problem, they drive my vehicle and they told me Its my problem I am not sitting properly on back seat. My problem is still not solved.
    When I was in Bangalore I consult with a private servicing center, they drive my vehicle and they are also agree with my problem. But I don't gave them my bike for service.
    I don't know why they are trying to ignore my problem. Thay are not trying to understand my problem. I am very upset for these kind of service from Hero Honda. It is India's best two wheeler Company but.
    Its condition is not so well. Please, try to understand my problem and take necessary step for my problem. I am still waiting for your valuable reply.
    My Vehicle No. is KA 50J 3108. Now I am applying for change of address and change of my Vehicle No. It will take 90 days for changing.
    Its really very Horrible Experience for me. I am also send my complaint on ickamboj@herohonda.com but there is no reply from their end.
    Please take necessary action.

    Dear Sir,

    My elder brother is having a splendor bike of registration no- DL6SP 5605 and chassis no – 05J16C34052 and hero Honda passport. He is expired on 8th November 09 in a road accident. As per policy of hero Honda passport, the owner gets a insurance cover of Rs. 1 lac in case of road accident. I Submitted all documents for processing of PA cover on 2nd January 2010 at ESS AAY Agencies (I) Pvt. Ltd. Showroom : 2336, Faiz Road , Karol Bagh, New delhi-110005 to Mr. Bhupendra. I talked at your hero Honda passport customer care (01126294052) around 10-12 times, every time they said that they received the documents but they did not updated in system. On 13/03/2010 they said that information on the passport cannot seen clearly, so they can not process the claim. Hero honda have all the record of bikes and hero honda passport. So they can check from there. This is excuse that information on the passport cannot seen clearly. Nearly 2 months have passed but I did not get any confirmation. My family needed money very urgent. Please confirm me till when will be the claim of PA Cover settle.

    I have gone through paid service (Only Service charges 175/- + Tax). Total Cost: 819/- on 11 Oct,2010

    The below exp makes the doubt about the Hero Honda's Quality of service centers and the so called "GENUINE PARTS".
    The service center ppl seems to be least bothered about the servicing and more concentrating on servicing the number of bikes than the quality.

    1. My front tire was getting jammed, intelligent Supervisor told to change the Disk Pad, but as of today (1/11/2010) Problem remains the same. I was got charged 488/- (308+100) + Tax. Don't know what quality pad is been used which is giving the problems after 15 days it self. Don�t have any kind of the proof that says the pads replaced are GENUINE.

    2. I told "NOT to change the Oil" because I changed it 15 days before, even though in the Job Card it was written "Not to Change the Oil", the Mechanic changed the Oil is been changed unnecessary. Charged me 149/- + Tax

    3. Bike supposes to be washed and polished but found improperly washed.
    - Cleaner Response "Bike was having too much mud".
    - Supervisor response " Lot of bikes are there so it happens. Service center don't do polish" [but Bangalore service center does]
    - I wonder how only Pune Hero Honda service center ppl has these problems.

    4. Can't believe that Service charges I paid those are worth to pay.

    1. Bike was taken for 2 whole working days just to check the break pads
    2. 5 days back on 13th Jan 2011, I found that front break pad again has issues.

    Can't understant the issue. Now I'm tired of follow up

    I sujit R. Chaudhari purchased new CBZ x-treme from authorised dealer in Pune named Pratham Motors on the date 28-feb-2011 with chassis No. MBLKC12ECBGB15456 and Engine No. KC12EBBGB15498.
    But after some day during ride with this Bike I noticed that there is Problem in Gear Shifting. so During my First servicing i told the same problem to the Service Person in the Pratham Motors, they note the problem,
    but after servicing I noticed that the Problem remains the same. this thing happens in every time of next servicing. I completed my 4 servicing from Pratham Motors but the Problem remains there. So i want to take action against them. So please help me?

    Angry Seeking justice from Hero Honda Show Room.

    Dear Sir,

    I have purchased new brand Hero Honda CBZ extreme(Chasis No: MBLKC12DFBGH08957) and Engine Number : (KC12EDBGH10620) in Hero Show room LAKSHMI HERO show room with address of: Amruth Ville, Rajbhavan Road, Somajiguda, Hyderabad - 500 082. In the month of December on 22-12-2011 with T/R number: Ap09UVTR6297 with Invoice number: 10794.

    I noticed that there was a manufacturing defect in bike engine. Due to that the bike is producing heavy white smoke because of this problem the bike is getting damaged I have taken this issue and went to showroom they have replaced the bore part but again there is another problem occurred in bike engine. the too much of sound is coming from bile engine and burning smell is coming from the bike after taking 10km rider with 45-50 km/hr speed. I am facing so much of problem with new bike. I have been to hero authorized show room so many times after noticing this issue in bike but there is no response from the higher authority people of service center. Please help me. I am almost lost.

    Unhappy hero honda cbz xtreme

    sir,iam bharath kumar i bought hero honda cbz xtreme in may 5th 2011.with in the period of 1 month they replaced the disk brake,engine,and problems are not solved till the problems are going on,i went to service center. sir the bike is pulling they did nt solve the problem due to this bike condition i met an accident in lakidikapool hyderbad.i claimed the insurance they replaced the parts and my bike is in not condition.with in the period of warranty they replaced the new one and i went to regional office they also not resolved.iam requested sir plz replace my bike they didnot give any response.there are so many replaced parts documents are there with me.there is threat to my life with this bike because the bike is not condition.my bike details chassis no:mblkc12ecbgc03077,engine no:kc12ebbgc03057.i sent a fax to hero honda company about my problems with documents i am requesting to the consumer court plz solve my problem and replace my bike.my email id:chbharathkumar@ymail.com,chbharathkmr@gmail.com ,mobile :9701196711

    ,I am Dinesh Tiwari from New Delhi .I bought a bike from Singla Agencies , Hero Honda CD Deluxe ( DL9S AF 8612 ) on dtd (08-01-2012) My bike Battery Charging is not working from 1000km,I asked my dealer & Service Manager regarding the problem. They said send for testing of battery . Then I gave my bike to Exide Industries Ltd on 16 march 2012 for testing of battery but his report for battery was working fine vide their ref no. DEL /OKL/EX 09748 . Then I again asked my dealer ( singla Ageicies ) regading the same problem this time they told us give your bike for 2nd Servicing and we will try to solve your problem .I gave my bike to servicing to singla Agencies on 21/03/2012 vide their Job card No. 11425-03-RCJ 0312-445 (1551 Km ) bu my problem was not solve.I asked them to replace the parts but they refused do it and the behaviour of manager and workers was very rude. I am Facing a lot of problem light and self start is not working because battery charging kit is not working

    Bina moters hero honda dealer ( Gandhi chowk, Jharsuguda) not given spares to customer. Pl. action taken strongly.
