    Hi,

    Recently i had issued a cheque of ICICI bank to my news paper agent of
    285 Rs and later It was debited for 5000 Rs. Even though it was
    clearly mentioned on the cheque "Not to pay More than 285". A written
    complaint is given to the bank and they are claiming that its a
    mistake from canara bank. Can I file a case against the bank in
    consumer court?

    If needed I can provide scanned copy of the cheque and the bank
    statement showing the transaction.

    Hi.
    First issue notice to the Bank(ICICI)demanding immediate re- credit of the
    wrong debit together with the interest, lest , threaten them to approach the
    appropriate legal fora for your redrassal.Send all the copy of correspondence to
    their higherups also.Wait for a month and you may either lodge a complaint to
    the Banking Ombudsman (of NO USE) or Consumer forum(yet to see the result).

    Yea you must the mistake is that of the ICICI Bank only who is supposed
    to debit the amount as per cheque, Also claim the damages of not only
    intrest but also for any other due to shortage of funds and
    harrassment C K BHATIA

    You can file case in consumer court as well as you can also file case in High
    court this.

    Same type of error happened to my friend though it was in HSBC bank, Bangalore.
    Looks like a new scam. The moment he brought it to the notice of the bank and
    demanded a copy of the cheque they reversed the amount.

    Hi:

    First get it in writing from ICICI bank that - that was mistake from Canara
    Bank. Produce the same letter to Canara bank and obtain their version only in
    writing.

    As per Banking rules, banks are not authorised to do any material alteration. If
    alteration is done by holder or agent of holder, then also you can sue
    presenting bank or issuing bank as the case may be.

    When you will ask everything in writing. Your money will be hopefully refunded
    to you. If they refund, their difieciency in service is automatically proved.
    Now you can negotiate with them compensation b4 moving to DF. If they treat you
    well and submit apology, close the matter.

    Recently I have taken INR 7.00 as compensation for making 2 telephone calls and
    HDFC Bank has issued INR 7.00 by cheque. But you need to be righteous in your
    right, documents and demands.

    Finally you have DF .....State Commission and National Commission and SC.

    First cross-check with Canara Bank thro your friends or thro their staffs. Then
    you can proceed against ICICI Bank. You have to get statements from your
    Newspaper agent confirming Rs285 being the cheque and his bill amount.
    ICICI bank is quite dangerous to deal since NO Manager would take the
    RESPONSIBILITY to help or solve your problem. They would shift their
    responsibility to Bombay office

    Dear Sir

    If you have issued chq of Rs 285/- and is debited Rs. 5000/-, the question is
    how much amount was credited to the newspaper agent account. If u r debited vide
    the same chq Rs. 5000/- then the same chq should be credited as Rs. 5000/- in
    newspaper agent account. take ur account statement and account statement of
    newspaper agent and tally both for the same chq. If they differ then theICICI
    bank is in soup. They have debited excess money then the chq received. You can
    question both banks in writing about the chq. Ask for the instrument. It cost
    Rs. 200/- for chq recovery in nationalised bank. Take both statements to icici
    bank and canara bank and resolve the issue. If still they are adament take the
    counsumer court course. It seems to me that ICICI bank has debited the amount of
    Rs. 5000/- and has put onus on canara bank to sort out the matter. In icici
    bank consumer has to be extra cautious as all blame is put on the consumers
    asfor them-
    BANK IS ALWAYS RIGHT.

    Impossible.If ther is a debit there must be a corresponding credit to some
    accout.If the full amount is credited to the Newspaperagents account,it is an
    error and the Bank can reverse the entry and credit to your account.If the agent
    got only his dues,what happend to the balance?The day book wont tally unless the
    entries(debit and credit)differs.Incase the balance is credited to some other
    head-say sundry creditors/suspense etc.then the Bank has to answer.In anycase
    please go thru the account statement and proceed accordingly..goodluck

    Care regarding cheque debit of Rs.5,000 instead of Rs.285 with Service Request
    SR87801880.

    mene rebonding ke ly 3000 rupees and meri frnd ne 2500 rupees diye hai lekin na to parlor walo ne rebonding thk se ki aur pata nai kon se product use kiye jis se hair fall bht jada hone lag gaya ..aur rebonding jiski 1 year tak nai khrab hoti wo sirf unki ki hui rebondi 1 week se b pehle khrab ho gai ...
    aur ab wo hmse sahi dhang se bat b nai karte agr hum bat karne jate hai to parlor me hote huye b hmesha jhuth bol dete hai ki waha nai hai .........
