I, Somesh Bhattacharya, had joined Electro Steel Castings Limited, as a Assistant Manager (sales and marketing) on 19.07.2010, after an interview held at their kolkata office on 16.07.2010. at the time of Interview Mr. D.P Mitra (sales head east) and Mr. S.K Mukherjee (AGM - Sales & marketing). I got their offer letter through mail and no salary part was mentioned there. But at the time of interview it was mutually fixed at 3.25 LPA CTC and other expenses as actual.

When I got my appoint letter I noticed it is not 3.25 LPA but mere 2.8LPA (without PF and Bonus),I, then asked Mr. S.K.Mukherjee (AGM) about this as he was my immediate boss. He outraged me and denied about the verbal commitment they had. I protest in writing but decided to work with the company on good faith as they may consider the case.

From the very next day they started being torched me mentally so that I would be Cat - Cornered in front of management. In this process I was used be confined in office till 9 PM idle while the entire other employees are freed after 6PM. They both used to use slang languages and keeping on pointing out that I am a failure. In-spite of all these i remain in the organisation, mainly for my Salary as they told it will be in the first week of September, and they did not paid me from 19.07.2010 to 30.07.2010 at 08/2010, they told it is due to SAP and My salary will be paid in addition to my 08/2010 salary in 09.2010.

On 13.08.2010 the thing out burst when Mr. S.K Mukherjee used very bad slang languages to me, he also threatened me to terminate, then I lost my patience and had a hot conversation with him. I left the office after that feeling that, I may be physically assaulted, by giving fake excuse on that day.

After that i send a sms to Mr. DPM and Mr. SKM that i am not willing to work any more and asked how to get a amicable settlement. They ware not replying and not receiving my phone. After that I submitted my resignation through mail on 30.08.2010 but not responded.

On 03.09.2010, i got one of them in phone (after calling from a different no.), Mr.DPM told me to come to the office on 04.09.2010 for the proceedings.

On 04.09.2010 when I arrived there, at 19, Camac street, 7'th floor about 11AM. After entering in the office they confined me in a closed chamber and both of them physically assaulted me. I react, and I was stronger than those two, I success ed to free myself. After that they told they will put me behind the BARS and file a case against me by putting false charges. they used very bad languages. they also make me signed in a white paper forcefully. However the junior clerck helped me by receiving my resignation and freed me from the fire exit.

Please advise me what to do? as I feel unsafe since they have big connections.

The consultant was Passion consultant who arranged all these for me.

Can i go to the court for compensation?

If this being work culture at Electro Steel Castings & Lanco Industries (owned by ESC), then Consumer Court should take strict/stringent action against the owners under various sections of IPC.

Professionals should aviod & stay away from such companies.

Hi, My employer not relived from my job and he chose using my balance 16 signed cheques left in the office deposited one day and filed 16 different cheque bouncing cases and due to criminal cases, I could not take up any employment. The cases went for 9 years and court acquitted. The company not relived settled my final accounts. I am not finding job now due to a long gap, How this type of employers prosecuted under law.
