A lawyer here has filed in the Patna High Court a petition challenging the dissolution of the Bihar legislative assembly.

The court has fixed hearing of the case after the summer vacation.

"The petition will be heard when the court reopens after the summer vacation next month," a high court official said Thursday.

Lawyer Nand Kishore Singh has argued in his petition that the Election Commission had issued a notification for the constitution of the assembly after the February elections.

Taking note of it, Governor Buta Sigh should have invited the legislators to take their oaths but he recommended dissolution of the house instead, the petition said.

Meanwhile, the opposition National Democratic Alliance (NDA) has also announced that it would seek legal action.

"We will move the court only behalf of the NDA legislators of the dissolved assembly and the 21 Lok Janshakti Party rebels and 17 Independents (backing us)," an NDA leader said.

The central government had Monday dissolved the Bihar assembly, saying this had become a "constitutional necessity" to prevent "horse-trading" by the opposition.
