Default Issue with Parking facility in Metropolitan Mall in Gurgaon

    Hi,
Actually, this happened on the December 25, 2007. I went to watch a movie
“Tarein zameen per in PVR in Metropolitan Mall in Gurgaon at 12.00 noon. I
parked my four wheeler in Second basement just in front of the Lift.

I put my parking slip in the car and the guard asked me to keep it in neutral
and without break. But he was not able to push it. So, I advised him to Eat
    well.

Now, after watching the movie, at around 3.15 p.m. I was getting out of parking
and then I came to know that my parking slip is missing. I was supposed to pay
Rs. 20/- for the parking. But now as I had lost my parking slip. He asked me to
show my Licence and RC, which was okay (in fact good). But in addition to this,
he demanded Rs. 75/- instead of Rs. 20/- to be paid for parking.

I met with the management person for the reason why I am asked to pay Rs. 55/-
extra (although was written on the board which i looked now). He said it is
because we don’t know at what time you entered in the parking.

Now, I asked that Guard to confirm that I entered only 3 hours back (and he
remembers me and tells the same). But still the management guy insisted to pay
Rs. 75/-. I asked him that this rule is not correct as i have proved that i came
only three hours back, Moreover, the vehicle is kept for driving and not to
leave them in the parking for long period. But still he says it is a matter of
Rs. 75/- only although you entered three hours back.

I checked with other Malls as well and they are also following the same rule.
According to me, this rule is absolutely wrong. When they were convinced that I
entered three hours back, still they cannot charge me Rs. 55/- extra. And I
wasted so much time due to them and was frustrated too. There must be many
instances like this on a daily basis. They are fooling people by saying we have
written it on our board, and rules are rules.

I think, this sort of rule is valid in developed countries where there are no
guards in the parking at all. and which are fully automatic. But being simple
copy cats should not happen. One should apply some mind and follow them as per
    the indian culture.

What do you suggest on this??? Am I wrong????

    Best Regards,
    Upender

    Dear Sir

In the first place never keep your parking slip in the car. What will happen if
your car gets stolen. You cannot make any claim on the parking contractor that
your car was parked in that area.

Though it is the rule that you have to show your RC/ identity in case of missing
parking slip and charges are on the higher side. Also laibility rest on
    contractor if any mishap happens.

    Hi Upender,

First of all, it is immaterial that you keep your Parkeing Slip in your Car or
    in Your Pocket.
Second thing, First CROSS CHECK that the Mall can accept the Payment either
partly or fully for Parking space, as per the Law or not.
Third: So many places, this Parking Contractors are themselves work as
Illegally as they do not have any Licence or they are given contract by teh
Government to collect the Parking, and the rates are fixed by the Government
    authorities.

As this is the case of Shopping Mall, that comes under Government Rules and
Regulations for collecting the Payment or not.

In so many cases, they clearly mention as IT IS NOT THEIR DUTY OR THE PARKING
VEHICLES ARE PARKED AT THE OWNERS RISK.

If you lost your Parking Slip, ask them to give you a Duplicate one, because
they must be having the same in their Record, if they have collected the amount,
and the time must be mentioned on the same. It is the Shopping Malls
responsibility as they have to show the collection in records or to pay the same
    to the Government.

I am not sure, this will help you or not, but cross check. I am from Mumbai,
and the Rules changes as per the States. Inform your incidence to everyone by
email or by phone, MOUTH PUBLICITY.

    Regards,

    Hi Amit,

Great......i will cross check the same......

first, whether it comes under Govt. rules or not? Whether they pay Govt. or not?

Actually, the initial in-receipt was provided by a automatic machine. how can
that slip identify that it is pertaining to my vehicle or not?

is there anything mentioned on that to specify that it is for this vehicle? Only
    time of entrance is mentioned.
I will cross check the same and revert back to you.

    Best Regards,
    Upender
