Hello Sir,
I am an employee of IT Company. It’s a Mumbai based Private Limited
Company. Its holding the biggest IT certifications [Don't know how he could
get such a valuable certification]. As per my appointment letter, if I wish
to leave the company I have to provide 90 days notice period.
Currently I am serving my notice period and complete around 80 days. I am
working at client side. Now My Project Manager called me and told me that he
is getting some complaints from client and now he will not provide relieving
letter to me. He is threatening me to provide the termination letter. I have
talked to my client about the same and he told me that there is not such
kind of discussion from my company management.
In my company they have some performance incentives which we can claim
quarterly. Form last one nd half year they have not provided the Performance
incentive and other allowances which is clearly mention in my appointment
letter.
Even they have provided LTA for the period of Jan-Dec 2008 in Sep 2009
(around one year late).
I am Coming to the Point ...
1. Are an Employer terminates the service of Employee if he/she is already
in notice period. How can I take proper relieving letter from them? What
should I do in such case?
2. I have heard that Employer can pay the wages for any Financial Year till
the July of that Year. After that Employee can take legal action. Or an
Employer can pay the pending due at any time. Is There any rule for that.
3. As per my company policy, they have not pay for earn leaves, even not
adjust my leaves in notice period. Can an Employer make such kind of rules?
I have heard that Employer must have to pay for Earn leaves. Is it true?
4. As per my company Policy, they do not pay salary for the last month.
They do F&F after 2 months of reliving. But they have not provided the F&F
amount of my previous colleagues who have resigned from the company even
after a year. Some lucky guys get the amount but it was around 10 - 20 % of
F&F amount. They asked for the company to provide the account how they
calculate the F&F amount but Company is not providing the description of the
same.
I know, I have asked lots of question, Hope you will understand my
situation and suggest me the best way.
