    Default Demage of Luggage by Alitalia airlines

    Hello.
    Recently I travelled to Germany by Alitalia Airlines and when I reached at Stuttgart (Germany) I found my luggage missing which was deposited to the airline staff at delhi. Ultimately airline traced my luggage after 4 days and handed over to my relatives. The Baggage was damaged and 500 euro lying the baggage and few cloths were found mising in the luggage. The matter was brought to the notice of Alitalia Airline office at Stuttgart by phone/email/fax. Now the company is saying to
    reimburse the cost of luggage only.
    Can any one suggest me any remedial action which i can initate against the airline. Also can any one quote/refer any judgements of consumer court/high court in the similar situations.

    Kindly give answers to the following:

    1. Did you see what was written in the fine print of the ticket issued to you ? There must be a point mentioning maximum liability in case of lost baggage or misplaced baggage

    2. Did the airline provide you with any kit containing the basic essentials like Brush, toothpaste, etc.. ?

    3. Did you contact their counter for complaining lost baggage and demanded compensation there and services/Euros for emergency ?

    4. Did you take compensation from your credit card /Insurance company for delayed baggage ?

    Thanks for your concern in the issue.
    Parawise Reply to your querry is as under :-

    1. There might be printed on ticket about liability in case of loss of baggage.
    2. No. nothing was provided to me not even tooth brush...
    3. Yeah. when I reached stuttgart (gemany) airport and when I noticed that out of two luggage I got only one. I brought the matter into the notice of the Customs/airline at airport. \they issued me a memo/letter with reference number. Their version was that as my flight from India to stuttgart was indirect via Milan(Italy), so luggage might be left at Milan. They assured me that in the evening or tomorrow they will collect and deliver the luggage. But daily I did Phone to airports at Sturttgart and Milan and i did number of emails and faxes about loss/non delivery of luggage. Ultimately after 4 days I got my luggage which was containing all daily use items and 500 euro. Money was missing alongwith one touser and choclate.
    4. till date I havenot claimed any compensation from insurance co or airline. In response to my emails/letters wirtten while I was in Germany, now airlline have offered me cost of luggage bag (being damaged zip as reported in my correspondence) upto Rs.2500/- provided Bill be forwarded to them. They are silent about other loss which i have occured.

    Kindly check your international credit card. They have specific facilities ( eg. GOLD CARD ICICI gives upto US$ 300 compensation for emergency purchases when the baggage lost / held up is for more than 12 hrs. I am talking about 2-3 yrs back. Now I am not aware how
    much )
    Check your Insurance policy papers. Certainly you must be having some US$ ...offered incase of baggage lost/delayed.

    However you can certainly go ahead and fight a case if nowehre they have mentioned that they shall offer only...Rs../US $ ...incase of baggage delayed.

    It is really surprising that they did not even offer you anything !!
    You mentioned:

    If it does then its a tough battle I remember I was offered a emergency Kit by AIR FRANCE
    when the baggage got delayed and in 24 hrs the baggage was traced and it was delivered to my hotel room which was @ 400-500 Kms from the Airport.

    You are citizen of India

    Nowhere Germany is involved.

    If its a mistake of German Airport, etc..that is ALITALIA'S problem,not yours.

    You are customer of ALITALIA AIRLINES, ITALY.

    You bought ticket of Alitalia from Indian Office.

    Hence you have to file case in Consumer court in India, preferably in New Delhi.
