Hi,

I had recently bought a second hand two wheeler motorcycle from a person. He sold the vehicle telling me that the vehicle was actually manufactured in the year 2000 though the R C book showed that it was 1989. He said the same cannot be corrected as the dealer has shut shop. Then i checked up with the manufacturer for the year of manufacture and was told that the same was 1989. I duly returned the vehicle on the same day to the seller and retained the papers of the vehicle till he clears the dues. But now he is keeping on postponing the date and is saying that he will sell the vehicle that he will pay me.

I have got a letter (with revenue stamp on the same) from him for the sum payed to him for the vehicle and also a letter for his taking the custody of the vehicle from me.

Can i take him to consumer court? If so what are the procedures that I need to follow.
